BILL NUMBER:S7218 TITLE OF BILL: An act to amend the education law, in relation to transportation of certain pre-kindergarten students PURPOSE: This bill will allow school districts, under certain circumstances, to optionally provide transportation for prekindergarten students. SUMMARY OF PROVISIONS: Section 1. Amends subdivision 1 of section 3635 of the education law by adding a new paragraph (g) which provides that a school district, if the superintendent indicates that there is no additional cost, may pick up and drop off children participating in a pre-kindergarten program taught by certified teachers of such school district at a district owned and utilized building. Section 2. Effective date. JUSTIFICATION: Transportation issues in rural areas can prohibit access to pre-kindergarten programs and thus impact the effectiveness of such programs. This legislation will give local school districts the choice to provide transportation for such programs so long as it does

BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to transportation of certain pre-kindergarten students THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 3635 of the education law is amended by adding a new paragraph g to read as follows: G. A PRE-KINDERGARTEN PROGRAM WHICH IS HELD AT A BUILDING OWNED OR LEASED BY A SCHOOL DISTRICT WHICH OTHERWISE UTILIZES SUCH BUILDING FOR SCHOOL CLASSES FOR GRADES KINDERGARTEN THROUGH TWELVE OR A PORTION THER- EOF MAY, IF THE SUPERINTENDENT OR OTHER OFFICIAL IN CHARGE OF SUCH DISTRICT INDICATES THERE IS NO ADDITIONAL COST, PICK UP AND DROP OFF CHILDREN PARTICIPATING IN A PRE-KINDERGARTEN PROGRAM TAUGHT BY CERTIFIED TEACHERS OF SUCH SCHOOL DISTRICT AT SUCH DISTRICT OWNED AND UTILIZED BUILDING. SUMMARY OF PROVISIONS: Section 1. Amends subdivision 1 of section 3635 of the education law by adding a new paragraph (g) which provides that the trustees or board of education of any school district, may, in their discretion, provide transportation for children attending another district sponsored or district-run pre-kindergarten program, within mileage limits established by the school district. The cost of providing transportation shall be a charge upon the district and shall not be aidable. Section 2. Effective date. Subdivision 1 of section 3635 of the education law is amended by adding a new paragraph g to read as follows: G. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THE TRUSTEES OR BOARD OF EDUCATION OF ANY SCHOOL DISTRICT MAY, IN ITS DISCRETION, PROVIDE TRANSPORTATION FOR STUDENTS ATTENDING A UNIVERSAL PRE-KINDERGARTEN PROGRAM IN ADDITION TO TRANSPORTATION FUNDED BY SUCH PROGRAM OR TRANSPORTATION FOR STUDENTS ATTENDING ANOTHER DISTRICT SPON- SORED OR DISTRICT-RUN PRE-KINDERGARTEN PROGRAM, WITHIN MILEAGE LIMITS ESTABLISHED BY THE SCHOOL DISTRICT; IF PROVIDED SUCH TRANSPORTATION SHALL BE OFFERED EQUALLY TO ALL CHILDREN IN LIKE CIRCUMSTANCES RESIDING IN THE DISTRICT. THE COST OF PROVIDING SUCH TRANSPORTATION SHALL BE A CHARGE UPON THE DISTRICT AND FOR PURPOSES OF SUBDIVISION SEVEN OF SECTION THIRTY-SIX HUNDRED TWO OF THIS CHAPTER, SUCH PUPILS SHALL BE CONSIDERED NON ALLOWABLE PUPILS AND THE COSTS OF THEIR TRANSPORTATION SHALL NOT BE AIDABLE.
