BILL NUMBER:S990 TITLE OF BILL: An act to amend the social services law, in relation to restricting placement of level two and level three sex offenders in any temporary emergency housing or homeless shelters used to house families with children PURPOSE OR GENERAL IDEA OF BILL: Prohibits placing of level 2 and 3 sex offenders in any temporary emergency housing or homeless shelters used to house families with children. SUMMARY OF SPECIFIC PROVISIONS: Adds a new section 131-y to the social services law prohibiting placement of level 2 and level 3 sex offenders in temporary housing or homeless shelters used to house families with children. JUSTIFICATION: This legislation would require municipalities to place homeless level 2 and level 3 sex offenders in adult-only shelters or emergency housing where they will not be in close contact with children. Sex offenders are already barred from living in public housing; this measure extends the same protection to homeless families.

NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW, NEITHER THE OFFICE OF CHILDREN AND FAMILY SERVICES, NOR A SOCIAL SERVICES OFFICIAL ACTING ON HIS OR HER OWN OR AS AN AGENT PURSUANT TO SECTION ONE HUNDRED THIRTY-EIGHT-A OF THIS TITLE, SHALL PERMIT OR CAUSE THE PLACEMENT OF ANY SEX OFFENDER WHO HAS BEEN ASSIGNED A LEVEL TWO OR LEVEL THREE DESIG- NATION PURSUANT TO ARTICLE SIX-C OF THE CORRECTION LAW, INTO ANY TEMPO- RARY EMERGENCY HOUSING OR HOMELESS SHELTERS USED TO HOUSE FAMILIES WITH CHILDREN.
