BILL NUMBER:S4508
TITLE OF BILL: An act to amend the labor law, in relation to employer
rates of contribution to the unemployment insurance fund
PURPOSE OR GENERAL IDEA OF BILL: Waive business unemployment
insurance increases due to members of the National Guard and Reserves
who are ordered to federal or state active duty for more than thirty
days.
SUMMARY OF SPECIFIC PROVISIONS: This legislation waives unemployment
insurance increases due to members of the National Guard and Reserves
who are ordered to federal or state active duty for more than thirty
days.
JUSTIFICATION: To encourage employers to employ and retain National
Guard and Reservists without fear of having to pay unemployment
insurance increases, if the members of the Guard or Reserve are
activated.
PRIOR LEGISLATIVE HISTORY: New Bill
FISCAL IMPLICATIONS To be determined.
EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the labor law, in relation to employer rates of contrib-
ution to the unemployment insurance fund
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 2 of section 581 of the labor law is amended by
adding a new paragraph (e) to read as follows:
(E) NOTWITHSTANDING ANY PROVISION OF THIS SECTION TO THE CONTRARY, A
QUALIFIED EMPLOYER'S RATE OF CONTRIBUTION AS DETERMINED UNDER THIS
SECTION SHALL NOT BE INCREASED AS A RESULT OF THE DEPLOYMENT OF ANY
EMPLOYEE INTO THE ACTIVE SERVICE OF THE NATIONAL GUARD OR ARMED FORCES
RESERVES FOR A PERIOD IN EXCESS OF THIRTY DAYS.
S 2. This act shall take effect immediately.
