BILL NUMBER:S5049
TITLE OF BILL: An act to amend the general municipal law, in relation
to crosswalks near athletic fields and playgrounds
PURPOSE OR GENERAL IDEA OF BILL: To require pedestrian crosswalks
along athletic fields and playgrounds to permit safe access and
passage across abutting streets to pedestrians visiting these
facilities.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 - provides that this act shall be known as "Erin's Law".
Section 2 - amends General Municipal Law by adding a new section 137,
which provides that crosswalks will be required near athletic fields
and playgrounds for all roads, other than restricted access highways,
at least every quarter mile to allow safe passage across the street
for pedestrians visiting these playgrounds and athletic fields.
Section 3 - provides that this act shall take effect two years after
it shall have become law.
JUSTIFICATION: On June 9, 2012, Erin Sulkowski, aged 13, was struck by
a car while crossing Maple Road in the Town of Amherst returning home
from a neighborhood playground. Eleven days later she passed away from

AN ACT to amend the general municipal law, in relation to crosswalks
near athletic fields and playgrounds
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. This act shall be known and may be cited as "Erin's law".
S 2. The general municipal law is amended by adding a new section 137
to read as follows:
S 137. CROSSWALKS NEAR ATHLETIC FIELDS AND PLAYGROUNDS. 1. NOTWITH-
STANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THERE SHALL BE A
CROSSWALK, AS DEFINED IN SECTION ONE HUNDRED TEN OF THE VEHICLE AND
TRAFFIC LAW, ACROSS EACH ROAD THAT ABUTS AN ATHLETIC FIELD OR PLAYGROUND
EVERY ONE THOUSAND THREE HUNDRED TWENTY FEET.
2. THERE SHALL BE A YIELD SIGN IN EACH DIRECTION OF TRAFFIC ALERTING
DRIVERS TO YIELD TO PEDESTRIANS IN THE CROSSWALK.
3. THIS SECTION SHALL NOT APPLY TO RESTRICTED HIGHWAYS.
S 3. This act shall take effect two years after it shall have become a
law.
