TITLE OF BILL:  An act to amend chapter 371 of the laws of 1997,
amending the parks, recreation and historic preservation law relating
to establishing the Mohawk Valley heritage corridor commission and
providing for the membership and powers and duties thereof, in
relation to the expiration thereof

PURPOSE OR GENERAL IDEA OF BILL:

Extends provisions relating to the Mohawk Valley heritage corridor
commission relating to the expiration thereof

SUMMARY OF SPECIFIC PROVISIONS:

Section 1. Amends section 4 of chapter 371 of the laws of 1997,
amending the parks, recreation and historic preservation law relating
to establishing the Mohawk Valley heritage corridor commission and
providing for the membership and powers and duties thereof, and
amended by chapter 218 of the laws of 2007 to extend the date of
sunset of the commission to 2023.

Section 2. Resurrects the provisions of section 37 of the parks,
recreation and historic preservation law, as repealed by section 4 of
chapter 371 of the laws of 1997, notwithstanding the provisions of
article 5 of the general construction law, to the full force and

effect as they existed on March 31, 2013.

Section 2. Establishes an immediate effective date for this act and
states that the act shall be deemed to have been in full force and
effect on and after April 1, 2013.

JUSTIFICATION:

The Mohawk Valley's history is unique and calls for a distinctive
system of recognition, protection, and partnership to maintain its
economic viability. Therefore it is fitting to be designated to join
the New York State Heritage Areas System. Chapter 371 of the laws of
1997, amended the parks, recreation and historic preservation law,
providing for the formation of the Mohawk Valley heritage corridor
planning commission and preparation of a regional management plan.
That plan provides for community revitalization and the development of
heritage tourism within the region. To date, the commission has
implemented the plan for the benefit of member counties, and continues
to assist in ongoing community revitalization and heritage tourism
efforts.

The provisions of law establishing the Mohawk Valley heritage corridor
commission (MVHCC) have expired and this bill would reinstate those
provisions. Given the Commission's success and the critical need fox.
its ongoing assistance, this legislation extends the Mohawk Valley
Heritage Corridor Commission from April 1, 2013 to April 1, 2023.

AN ACT to amend chapter 371 of the laws of  1997,  amending  the  parks,
  recreation  and historic preservation law relating to establishing the
  Mohawk Valley heritage  corridor  commission  and  providing  for  the
  membership  and  powers and duties thereof, in relation to the expira-
  tion thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 4 of chapter 371 of the laws of 1997, amending the
parks, recreation and historic preservation law relating to establishing
the Mohawk Valley heritage corridor commission  and  providing  for  the
membership  and  powers and duties thereof, as amended by chapter 218 of
the laws of 2007, is amended to read as follows:
  S 4. This act shall take  effect  on  the  first  day  of  April  next
succeeding the date on which it shall have become a law, provided howev-
er that prior to such effective date the Mohawk Valley heritage corridor
planning commission created pursuant to section 13 of chapter 666 of the
laws  of  1994  shall continue and shall be deemed to have the necessary
and appropriate authority, consistent with section one of this  act,  to
implement the Mohawk Valley heritage corridor management plan, if it has
been  approved  by  the  commissioner  of parks, recreation and historic
preservation, until the organization meeting of the Mohawk Valley herit-
age corridor commission, created by  this  act,  is  held  and  provided
further  that effective immediately the appropriate authorities may take
actions necessary to make appointments to  the  Mohawk  Valley  heritage
corridor  commission  before  the  effective  date of this act; provided
further that article 37 of title G of the parks, recreation and historic
preservation law as added by section one of this act shall expire  April
1,  [2013] 2023 when upon such date the provisions of such article shall

be deemed repealed; and provided further, section two of this act  shall
take effect June 17, 1997.
  S  2.  Notwithstanding  the  provisions  of  article  5 of the general
construction law, the provisions of article 37 of the parks,  recreation
and  historic  preservation law, as repealed by section 4 of chapter 371
of the laws of 1997, are hereby revived and shall continue in full force
and effect as such provisions existed on March 31, 2013.
  S 3. This act shall take effect immediately and  shall  be  deemed  to
have been in full force and effect on and after April 1, 2013.
