BILL NUMBER:S5699
TITLE OF BILL: An act to amend the county law, in relation to the
ability of counties to switch from a medical examiner to a coroner
system
PURPOSE:
Permits Delaware County more flexibility by allowing it the option of
either a medical examiner or a coroner system
SUMMARY OF PROVISIONS:
Allows a county that has changed to a medical examiner system to
revert to a coroner system at local option and by local law
EXISTING LAW:
Current law permits a county to change to a medical examiner from a
coroner system. No current provision exists in the law to allow a
county, at its option, to revert to a coroner system
JUSTIFICATION:
The ability for a county to revert to a coroner system, after once
having changed to a medical examiner, has not been explicitly granted

AN ACT to amend the county law, in relation to the ability of counties
to switch from a medical examiner to a coroner system
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 671 of the county law is amended by adding a new
subdivision 4 to read as follows:
4. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, DELAWARE COUNTY MAY,
THROUGH LOCAL LAW, REESTABLISH THE OFFICE OF CORONER AND ABOLISH THE
MEDICAL EXAMINER OFFICE AND MEDICAL EXAMINER POSITION.
S 2. This act shall take effect immediately.
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
[ ] is old law to be omitted.

JUSTIFICATION: The ability for a county to revert to a coroner system,
after once having changed to a medical examiner, has not been
explicitly granted in county law. Delaware County, having changed to a
medical examiner, finds it difficult to fill even after an extensive
outreach, given the unique licensing requirements and skills necessary
for a medical examiner. Delaware County wishes to revert to the
coroner system, in order to fill this essential local function.

3-C. CORONER IN DELAWARE COUNTY. THE COUNTY OF DELAWARE MAY REESTAB-
LISH THE OFFICE OF CORONER AND ABOLISH THE MEDICAL EXAMINER OFFICE AND
MEDICAL EXAMINER POSITION, PURSUANT TO THE ADOPTION OF A LOCAL LAW.
S 2. This act shall take effect immediately.
