BILL NUMBER:S7343 TITLE OF BILL: An act to amend the insurance law, in relation to motor vehicle law enforcement fees PURPOSE: To reduce the motor vehicle law enforcement fee from ten dollars to five dollars. SUMMARY OF PROVISIONS: Amends section 9110 (b) of the insurance law to reduce the motor vehicle law enforcement fee from ten dollars to five dollars. JUSTIFICATION: The motor vehicle law enforcement fee was originally authorized in 1992 as a one dollar fee on every insured vehicle in the state. The funding was intended to help law enforcement combat insurance related fraud and crime, including auto theft. The goal is that, by committing these resources to cut down on fraud, it should help to keep auto insurance premiums in check. This fee was raised from one dollar to five dollars in 2003, and to ten dollars in 2009. Although the initial goal of the program is a worthy one, only a small portion of the fee actually goes to fight insurance fraud as was the original

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to motor vehicle law enforcement fees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subsection (b) of section 9110 of the insurance law, as amended by section 1 of part T of chapter 56 of the laws of 2009, is amended to read as follows: (b) The annual fee is hereby imposed at the rate of [ten] FIVE dollars per insured motor vehicle registered pursuant to the provisions of para- graph b of subdivision one of section four hundred one of the vehicle and traffic law. Provided, however, that such fee shall be reduced by fifty percent per insured motor vehicle registered pursuant to the provisions of paragraph b of subdivision one of section four hundred one of the vehicle and traffic law where a policy issued in the state or for delivery in the state for motor vehicle liability insurance coverage is for a term of six months or less. Such fee will be paid monthly by insurance companies to the superintendent on or before the fifteenth of the month next succeeding the month in which such collections are received. S 2.
