AN ACT to establish the "capacity zone" task force and providing for the
repeal of such provisions upon expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. There is hereby established the capacity zone task force
consisting of the chairman of the public service commission, the presi-
dent of the New York state energy and research development authority,
the president of PSEG Long Island, the president of the New York power
authority, the commissioner of environmental conservation, the commis-
sioner of economic development, two members of the senate whose
districts sit within the new capacity zone as established by the federal
energy regulatory commission, one who shall be appointed by the tempo-
rary president of the senate and one who shall be appointed by the lead-
er of the minority conference, and two members of the assembly whose
districts sit within the new capacity zone as established by the federal
energy regulatory commission, one who shall be appointed by the speaker
of the assembly and one who shall be appointed by the minority leader,
and a designee of the governor. Members of the task force may designate
an executive staff representative to participate on the task force on
their behalf.
S 2. The role of the task force includes, but is not limited to,
creating and implementing a conservation plan to reduce electricity
demand in the counties of Nassau, Suffolk, and Westchester and the city
of New York by twelve hundred megawatts, thereby alleviating the need
for the new capacity zone.
S 3. The task force and the implementation of the task force's plan
shall be funded by the system benefits charge.
S 4. The task force shall complete the conservation plan within ninety
days of the effective date of this section and thereafter present the
plan to the governor, temporary president of the senate and the speaker
of the assembly. The task force shall begin implementation of the plan

within one hundred eighty days of the effective date of this section and
complete implementation of the plan within one and a half years of the
effective date of this section.
S 5. This act shall take effect immediately and shall expire and be
deemed repealed three years after such date.
