BILL NUMBER:S7510 TITLE OF BILL: An act to amend the education law, in relation to exemption from physical education classes for students participating in interscholastic sports PURPOSE: When enrolled in an interscholastic sport, a student is exempted from prescribed physical education classes during the duration of the interscholastic sport season. SUMMARY OF PROVISIONS: Section 803 (1) of the Education Law is amended to provide that students in middle and secondary schools who are participating/enrolled in interscholastic sports, shall be exempt from the prescribed physical education courses required by New York State. JUSTIFICATION: Currently, most students who are participating in interscholastic sports are also required to take physical education classes. The goal of mandated physical education classes is to improve physical fitness, physical skills and knowledge of physical education activities. This goal is also met by participation in interscholastic sports.

FARLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to exemption from phys- ical education classes for students participating in interscholastic sports THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 803 of the education law, as amended by chapter 118 of the laws of 1957, is amended to read as follows: 1. All pupils above the age of eight years in all elementary and secondary schools, shall receive as part of the prescribed courses of instruction therein such physical education under the direction of the commissioner of education as the regents may determine. Such courses shall be designed to aid in the well-rounded education of pupils and in the development of character, citizenship, physical fitness, health and the worthy use of leisure. Pupils above such age attending the public schools shall be required to attend upon such prescribed courses of instruction. PUPILS PARTICIPATING IN INTERSCHOLASTIC SPORTS SHALL BE EXEMPT, ONLY FOR THE DURATION OF THE INTERSCHOLASTIC SPORT SEASON, FROM THE PRESCRIBED COURSES OF PHYSICAL EDUCATION REQUIRED BY THIS SECTION.
