HOOPER -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to requiring jewelry repairers to return removed portions of jewelry that is being repaired to consumers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 392-j to read as follows: S 392-J. JEWELRY REPAIR; RETURN OF JEWELRY TO CONSUMER. A JEWELRY REPAIRER SHALL RETURN ANY PORTION OF JEWELRY WHICH IS REMOVED FROM THE ITEM BEING REPAIRED TO THE CONSUMER AND SHALL INFORM THE CONSUMER OF THE VALUE OF SUCH PORTION OF JEWELRY. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05698-01-3

HOOPER -- read once and referred to the Committee on Consumer Affairs and Protection -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the general business law, in relation to requiring jewelry repairers to return removed portions of jewelry that is being repaired to consumers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 392-j to read as follows: S 392-J. JEWELRY REPAIR; RETURNING REPAIRED JEWELRY TO CONSUMER. 1. DEFINITIONS. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "JEWELRY REPAIRER" SHALL MEAN ANY PERSON, PARTNERSHIP, FIRM, ASSO- CIATION, CORPORATION, OR AGENT OR EMPLOYEE THEREOF THAT DERIVES ANY PORTION OF GROSS INCOME FROM JEWELRY REPAIR. (B) "JEWELRY REPAIR" SHALL INCLUDE, BUT IS NOT LIMITED TO, POLISHING, STONESETTING, ENGRAVING, BRAZING, FORGING, FABRICATION, ELECTROPLATING, ENAMELING, WATCHMAKING, AND ANTIQUE RESTORATION SERVICES. 2. WHEN, AFTER THE REPAIR OF AN ITEM OF JEWELRY, ANY SIGNIFICANT PORTION OF THE JEWELRY HAS BEEN REMOVED, A JEWELRY REPAIRER SHALL RETURN THE REMOVED PORTION TO A CONSUMER. S 2.
