KATZ, RAIA, SALADINO, FINCH -- Multi-Sponsored by -- M. of A. CORWIN -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to reporting convictions of illegal aliens THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 265.30 of the penal law is amended to read as follows: S 265.30 Certain convictions to be reported. Every conviction under this article or section 400.00, of a person who is not a citizen of the United States, shall be certified to the proper officer of the United States government by the district attorney of the county in which such conviction was had. ALSO EVERY CONVICTION UNDER THIS CHAPTER OF A PERSON WHO IS DETERMINED TO BE AN ILLEGAL ALIEN SHALL BE CERTIFIED TO THE UNITED STATES DEPARTMENT OF HOMELAND SECURITY BY THE DISTRICT ATTORNEY OF THE COUNTY IN WHICH SUCH CONVICTION WAS HAD WITH THE RECOMMENDATION THAT ACTION BE TAKEN TO DEPORT SUCH PERSON. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
