AN ACT to amend the administrative code of the city of New York, the
vehicle and traffic law and the state finance law, in relation to
funding the animal population control fund
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 17-812 of the administrative code of the city of
New York is amended by adding a new subdivision 4 to read as follows:
4. AN AMOUNT NOT TO EXCEED FIFTEEN PERCENT OF THE BALANCE OF THE FUND
AT THE BEGINNING OF EACH FISCAL YEAR SHALL BE AVAILABLE FOR THE PURPOSES
OF IMPLEMENTATION AND PROMOTION OF THE ANIMAL POPULATION CONTROL PROGRAM
ESTABLISHED PURSUANT TO SECTION 17-811 OF THIS CHAPTER. SUCH PROMOTION
SHALL INCLUDE EDUCATING THE PUBLIC ABOUT THE BENEFITS ASSOCIATED WITH
SPAYING AND NEUTERING AND WHERE TO OBTAIN LOW-COST SPAYING AND NEUTERING
SERVICES.
S 2. Subdivision 2 of section 404-p of the vehicle and traffic law, as
amended by chapter 577 of the laws of 2007, is amended to read as
follows:
2. A distinctive Animal Population Control Fund plate issued pursuant
to this section shall be issued in the same manner as other number
plates upon the payment of the regular registration fee prescribed by
section four hundred one of this article provided, however, that an
additional annual service charge of twenty-five dollars shall be charged
for such plate. All monies received as annual service charges under this
section shall be deposited to the credit of the animal population
control fund established pursuant to section ninety-seven-xx of the
state finance law, and shall be used for animal population control
programs undertaken pursuant to section one hundred seventeen-a of the
agriculture and markets law, EXCEPT THAT ALL MONIES RECEIVED AS ANNUAL
SERVICE CHARGES UNDER THIS SECTION FROM NEW YORK CITY RESIDENTS SHALL BE
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

DEPOSITED TO THE CREDIT OF THE ANIMAL POPULATION CONTROL FUND CREATED
PURSUANT TO SECTION 17-812 OF THE ADMINISTRATIVE CODE OF THE CITY OF NEW
YORK AND SHALL BE USED FOR THE ANIMAL POPULATION CONTROL PROGRAM UNDER-
TAKEN PURSUANT TO SECTION 17-811 OF THE ADMINISTRATIVE CODE OF THE CITY
OF NEW YORK.
S 3. Section 97-xx of the state finance law is amended by adding a new
subdivision 5 to read as follows:
5. NOTWITHSTANDING THE PROVISIONS OF THIS SECTION, ALL MONIES DEPOSIT-
ED, CREDITED TO OR TRANSFERRED FROM ANY FUND OR SOURCE TO THE ANIMAL
POPULATION CONTROL FUND ESTABLISHED PURSUANT TO THIS SECTION, INCLUDING
BUT NOT LIMITED TO, SECTIONS THREE HUNDRED SEVENTY-SEVEN-A, THREE
HUNDRED SEVENTY-NINE, NINETY-SIX-E AND NINETY-SIX-H OF THE AGRICULTURE
AND MARKETS LAW, SECTION THREE HUNDRED NINETY-NINE-AA OF THE GENERAL
BUSINESS LAW, AND SECTION FOUR HUNDRED FOUR-P OF THE VEHICLE AND TRAFFIC
LAW, THAT EMANATE FROM ANY RESIDENT OR SOURCE IN NEW YORK CITY SHALL BE
FORWARDED BY THE STATE COMPTROLLER TO THE ANIMAL POPULATION CONTROL FUND
ESTABLISHED PURSUANT TO SECTION 17-812 OF THE ADMINISTRATIVE CODE OF THE
CITY OF NEW YORK.
S 4. This act shall take effect on the ninetieth day after it shall
have become a law.
