AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to displaying live races and special events on telephones
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivisions 4-a and 5 of section 1012 of the racing, pari-
mutuel wagering and breeding law, subdivision 4-a as amended by chapter
18 of the laws of 2008 and subdivision 5 as amended by section 10 of
part O of chapter 59 of the laws of 2012, are amended to read as
follows:
4-a. For the purposes of this section, "telephone betting accounts"
and "telephone wagering" shall mean and include all those wagers which
utilize any wired or wireless communications device, including but not
limited to wireline telephones, wireless telephones, and the internet,
to DISPLAY LIVE RACES AND SPECIAL EVENTS AND transmit the placement of
wagers on races and special events offered by any regional off-track
betting corporation, and any harness, thoroughbred, quarter horse racing
association or corporation licensed or franchised to conduct pari-mutuel
racing in New York state.
5. The provisions of this section shall NOT BE SUBJECT TO THE
PROVISIONS OF SECTION ONE THOUSAND THREE OF THIS ARTICLE INSOFAR AS
THOSE PROVISIONS REQUIRE THE PARTICIPATION AS A CONTRACTING PARTY OR
OTHERWISE OF THE REGIONAL OFF-TRACK BETTING CORPORATION, HOWEVER NO
RACES OR SPECIAL EVENTS SHALL BE DISPLAYED WITHOUT THE EXPRESS CONSENT
OF THE ORIGINATOR OF THE RACES OR SPECIAL EVENTS, AND THIS SECTION SHALL
expire and be of no further force and effect after June thirtieth, two
thousand thirteen.
S 2. This act shall take effect immediately, provided, however, that
the amendments to subdivisions 4-a and 5 of section 1012 of the racing,
pari-mutuel wagering and breeding law made by section one of this act
shall expire on the same date as such section expires.
