AN ACT to amend the transportation law, in relation to  authorizing  the
  commissioner of transportation to provide for an alternative system of
  inspection of certain vehicles

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 33 of section 14 of the transportation  law  is
amended by adding a new paragraph (c) to read as follows:
  (C)  THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS PROVIDING
FOR AN ALTERNATIVE SYSTEM OF INSPECTION  OF  SUCH  VEHICLES  ON-SITE  AT
DEPOTS  AND OTHER APPROVED FACILITIES, INCLUDING A FEE SCHEDULE FOR SUCH
ON-SITE INSPECTION REGIMEN AND THE ISSUANCE OF A CERTIFICATE OF  COMPLI-
ANCE  THAT,  UPON DISPLAY DURING A ROADSIDE INSPECTION, WILL EXEMPT SUCH
VEHICLES FROM SUCH ROADSIDE INSPECTION.
  S 2. Paragraph b of subdivision 2 of section 140 of the transportation
law, as amended by section 5 of part G of chapter  58  of  the  laws  of
2012, is amended to read as follows:
  b. The department shall have the power to examine vehicles, facilities
and  records  subject to the provisions of this subdivision, at any time
and place where they are found, to  ascertain  whether  such  rules  and
regulations  are  being obeyed. The rules and regulations of the commis-
sioner shall provide for the inspection of all such vehicles, facilities
and records subject to the provisions of this subdivision, at such peri-
ods and at such  manner  as  the  commissioner  may  direct,  and,  when
adopted,  shall  have  the full force and effect of law.  SUCH RULES AND
REGULATIONS SHALL ALSO PROVIDE FOR AN ALTERNATIVE SYSTEM  OF  INSPECTION
OF  SUCH  VEHICLES  ON-SITE  AT  DEPOTS  AND  OTHER APPROVED FACILITIES,
INCLUDING A FEE SCHEDULE FOR SUCH ON-SITE  INSPECTION  REGIMEN  AND  THE
ISSUANCE  OF  A  CERTIFICATE  OF  COMPLIANCE THAT, UPON DISPLAY DURING A
ROADSIDE  INSPECTION,  WILL  EXEMPT  SUCH  VEHICLES  FROM  THE  ROADSIDE
INSPECTION.
  S 3. This act shall take effect immediately.
