Provides for transfer of a student's academic and medical records to new school by the school district in which student was previously enrolled within 2 days of notification of said transfer; records shall include all records maintained by a school or school district which are subject to the provisions of 20 USC 1232-g.

AN ACT to amend the education law, in relation to release of records

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 2-a of the education law is amended by adding a new
closing paragraph to read as follows:
  WITHIN TWO DAYS OF BEING NOTIFIED THAT  A  CHILD  HAS  TRANSFERRED  TO
ANOTHER  SCHOOL  DISTRICT  OR  TO  A  PRIVATE  OR CHARTER SCHOOL, SCHOOL
AUTHORITIES IN THE SCHOOL DISTRICT OR PRIVATE SCHOOL OR  CHARTER  SCHOOL
IN  WHICH  THE  CHILD  WAS PREVIOUSLY ENROLLED SHALL TRANSFER ALL OF THE
CHILD'S RECORDS TO THE SCHOOL IN  WHICH  THE  CHILD  HAS  ENROLLED.  FOR
PURPOSES OF THIS SECTION STUDENT RECORDS SHALL INCLUDE ALL RECORDS MAIN-
TAINED  BY  A  SCHOOL  OR  SCHOOL  DISTRICT  WHICH  ARE  SUBJECT  TO THE
PROVISIONS OF 20 USC 1232-G.
  S 2. This act shall take effect immediately.
