AN  ACT  to  amend the education law, in relation to the installation of
  carbon monoxide detectors in schools

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.   Short title. This act shall be known and may be cited as
the "school buildings carbon monoxide detectors act".
  S 2.  The education law is amended by adding a new section 411 to read
as follows:
  S 411. INSTALLATION OF CARBON MONOXIDE DETECTORS.  1. (A) EVERY SCHOOL
DISTRICT SHALL ESTABLISH A PLAN TO INSTALL AND MAINTAIN CARBON  MONOXIDE
DETECTORS  IN  EVERY  ELEMENTARY  AND  SECONDARY  SCHOOL BUILDING IN THE
DISTRICT WITHIN SIX MONTHS OF THE DATE THIS  SECTION  SHALL  HAVE  TAKEN
EFFECT.
  (B) AT A PROPOSITION FOR CAPITAL AND/OR ATHLETIC FACILITY IMPROVEMENTS
FOLLOWING  THE  EFFECTIVE  DATE  OF  THIS SECTION, EVERY SCHOOL DISTRICT
SHALL INCLUDE THE COST OF INSTALLATION  OF  CARBON  MONOXIDE  DETECTORS.
COMPLETED INSTALLATION OF CARBON MONOXIDE DETECTORS SHALL OCCUR NO LATER
THAN  SIX  MONTHS  AFTER  A  SCHOOL DISTRICT BEGINS TO IMPLEMENT CAPITAL
CHANGES APPROVED BY VOTERS FOLLOWING THE BONDING PROPOSITION.
  2.  NOTWITHSTANDING  SUBDIVISION  ONE  OF  THIS  SECTION,  THE  SCHOOL
DISTRICTS OF THE CITY OF NEW YORK, YONKERS, BUFFALO, ROCHESTER AND SYRA-
CUSE  SHALL  ESTABLISH  A  PLAN  TO INSTALL AND MAINTAIN CARBON MONOXIDE
DETECTORS IN EVERY ELEMENTARY  AND  SECONDARY  SCHOOL  BUILDING  IN  THE
DISTRICT  AND SHALL SUBMIT SUCH PLAN WITHIN NINE MONTHS OF THE DATE THIS
SECTION SHALL HAVE TAKEN EFFECT TO  THE  COMMISSIONER  FOR  HIS  OR  HER
APPROVAL.  THE  PLAN SHALL INCLUDE THE SCHOOL DISTRICT'S PROJECTED TIME-
LINE FOR THE INSTALLATION OF CARBON MONOXIDE DETECTORS, AS  REQUIRED  BY
THIS SECTION.
