AN ACT establishing the school energy efficiency program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. School energy efficiency program. 1. Establishment. Subject
to  available appropriation, there is hereby established in the New York
state energy research and development authority the school energy  effi-
ciency  program.  Under  this  program grants may be awarded to eligible
entities for the  reimbursement  of  allowable  costs  incurred  in  the
purchase and installation of certain energy efficiency technology.
  2.  Allocation  of  funds under the program. The authority shall award
grants based on student enrollment at eligible entities.  The  authority
shall  determine  an appropriate dollar amount per student to be used to
calculate grant amounts based on available funding and the total student
enrollment in all  eligible  entities.  Eligible  entities  may  receive
awards  in an amount equal to the number of students enrolled multiplied
by the determined dollar amount but grants may not exceed actual costs.
  3. School energy devices. For the purpose of this program school ener-
gy devices shall mean technology or equipment identified by the authori-
ty in existing programs to increase energy efficiency.
  4. Eligible entity. For the purposes of this program  eligible  entity
shall  mean  any  public  or  nonpublic  elementary  or secondary school
located in New York state.
  5. Grants. The president of the authority shall develop guidelines for
the application process, allowable costs, awarding  of  grants  and  any
other  guidelines  necessary  to implement this program. Grants shall be
used exclusively to reimburse grantees for actual  costs  of  purchasing
and  installing  school  energy  devices.  Grants shall only be used for
secular energy efficiency purposes.
  S 2. This act shall take effect immediately.
