AN ACT to amend the  environmental  conservation  law,  in  relation  to
  prohibiting  the  use of the neonicotinoids class of chemicals for use
  in seed dressing, treatment or coating

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The environmental conservation law is amended by adding a
new section 37-0115 to read as follows:
S 37-0115. PROHIBITION OF USE OF THE NEONICOTINOIDS CLASS  OF  CHEMICALS
             FOR USE IN SEED DRESSING, TREATMENT OR COATING.
  IT  SHALL  BE  UNLAWFUL  FOR ANY PERSON TO DISTRIBUTE, SELL, OFFER FOR
SALE OR USE THE CLASS OF CHEMICALS NEONICOTINOIDS,  INCLUDING  IMIDACLO-
PRID, CLOTHIANIDIN AND THIAMETHOXAM, FOR USE IN SEED DRESSING, TREATMENT
OR COATING WITHIN THIS STATE.
  S  2.  This  act shall take effect January 1, 2015; provided, however,
that effective immediately, the addition and/or repeal of  any  rule  or
regulation necessary for the implementation of this act on its effective
date  are  authorized and directed to be made and completed on or before
such effective date.
