AN ACT to amend the general business law,  in  relation  to  prohibiting
  hidden mobile device spying and stalking

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new article
29-CCC to read as follows:

                             ARTICLE 29-CCC
                       BAN ON HIDDEN MOBILE DEVICE
                      SPYING AND STALKING PROGRAMS

SECTION 540. DEFINITIONS.
        541. PROHIBITIONS.
        542. ENFORCEMENT.
  S 540. DEFINITIONS. AS USED IN THIS ARTICLE, THE FOLLOWING TERMS SHALL
HAVE THE FOLLOWING MEANINGS:
  1. "PORTABLE ELECTRONIC DEVICE" SHALL MEAN ANY HAND-HELD MOBILE  TELE-
PHONE,   AS  DEFINED  BY  SUBDIVISION  ONE  OF  SECTION  TWELVE  HUNDRED
TWENTY-FIVE-C OF THE VEHICLE AND TRAFFIC LAW, PERSONAL DIGITAL ASSISTANT
(PDA), HANDHELD DEVICE WITH MOBILE DATA ACCESS, LAPTOP COMPUTER,  PAGER,
BROADBAND PERSONAL COMMUNICATION DEVICE, TWO-WAY MESSAGING DEVICE, ELEC-
TRONIC GAME, OR PORTABLE COMPUTING DEVICE OR ANY OTHER ELECTRONIC DEVICE
WHEN  USED  TO  INPUT, WRITE, SEND, RECEIVE, OR READ TEXT FOR PRESENT OR
FUTURE COMMUNICATION.
  2. "INTERNET CAPABLE" SHALL MEAN ANY PORTABLE ELECTRONIC  DEVICE  THAT
IS  INDIVIDUALLY  OR COLLECTIVELY CAPABLE OF PROVIDING WIRELESS OR WIRE-
LINE INTERNET ACCESS, IN ADDITION TO ORIGINATION AND COMPLETION OF TELE-
PHONE CALLS.
  3. "ELECTRONIC MESSAGE" SHALL MEAN A  MESSAGE  SENT  OR  POSTED  TO  A
UNIQUE  DESTINATION,  COMMONLY  EXPRESSED  AS  A  STRING  OF CHARACTERS,
CONSISTING OF A UNIQUE USER NAME OR MAILBOX (COMMONLY REFERRED TO AS THE
"LOCAL PART") AND A REFERENCE TO AN INTERNET DOMAIN  (COMMONLY  REFERRED

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.
