AN ACT to amend the general business law, in relation to providing
consumers with certain information disclosed by businesses

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Legislative intent. The legislature hereby finds and
declares that technological advances have allowed businesses of all
sizes and varieties to collect and maintain customer data with increas-
ing ease. The legislature further finds that the data being collected
and maintained is often personal in nature, and can be used by busi-
nesses for direct marketing purposes or for gaining an understanding of
consumer behavior. The legislature further finds that some businesses,
unbeknownst to their customers, sell or have sold their customers'
personal information to third party entities, including data brokers.
The legislature finds this type of information sharing to be a potential
invasion of privacy and a tool that may be used by the unscrupulous to
commit fraud and identity theft crimes, which are plaguing our state.
Further, the legislature finds that the issues surrounding the sharing
of personal information are compounded by the absence of a mechanism
whereby consumers can discover if and what personal information is being
sold.
Therefore, it is the intent of the legislature to provide consumers
with the "right to know" whether a business with which they have an
established business relationship is sharing their personal information,
the nature of the information that is being shared, and with whom the
information is being shared. By providing consumers with the ability to
know if a business is sharing their information and with whom their
information is being shared, New Yorkers will be afforded the opportu-
nity to make more informed and educated marketplace decisions.
