BILL NUMBER:S1317 TITLE OF BILL: An act to amend the surrogate's court procedure act, in relation to the compensation of the public administrators SUMMARY OF SPECIFIC PROVISIONS: Amends Section 1105 of the surrogate's court procedure act to provide that the Public Administrators in New York City would receive at least ninety percent of the amount paid to judges of the Surrogate's Court of the counties in New York City. JUSTIFICATION: Current law sets the salary of Public Administrators as at least two-thirds of the salary of Judges of the Surrogate's Court. In a recent change by the New York City Council, this was adjusted to at least 90% of the salary of Judges of the Surrogate's Court. This legislation will conform State law to the City statute. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the surrogate's court procedure act, in relation to the compensation of the public administrators THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 1105 of the surrogate's court procedure act, as amended by chapter 751 of the laws of 2004, is amended to read as follows: 1. The public administrators of the counties comprising the city of New York shall receive at least [two-thirds] NINETY PERCENT of the amount paid to the judges of the surrogate's court of the counties with- in the city of New York. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
