BILL NUMBER:S1342

TITLE OF BILL:
An act
to amend the public authorities law, in relation to the powers and
duties of the power authority of the state of New York

PURPOSE:
To expand the programs and services of the New York Power
Authority

SUMMARY OF PROVISIONS:
Section 1 of this bill would amend Public Authorities Law
§1005(17)(b)(2) and (4) to: (1) add "research, development and
demonstration of new systems, technologies and materials relating to
energy usage, storage, transmission and efficiency" to the definition
of "energy-related projects, programs and services;" and (2) clarify
that "high performance and sustainable building programs and
services" includes programs and services related to construction, in
addition to renovation and retrofitting, of buildings, and that such
programs and services may be addressed to the use of clean energy and
fuels in addition to renewable energy.

Section 2 of this bill would provide for the bill's effective date

JUSTIFICATION:
Expanding NYPA's "energy-related projects, programs
and services" to include "research; development and demonstration of
new systems, technologies and materials relating to energy usage,
storage, transmission and efficiency," would provide a basis to help
the State's colleges and universities remain competitive in these
subject areas, and could help stimulate vital partnerships and other
joint endeavors between the State, the State's businesses and these
institutions. The marriage of these interests could lead to
significant new "Made in New York" innovations in the energy field
which in turn would support the State's energy and environmental
policies as well as support economic development in New York.

Additionally, this bill would clarify that NYPA's high performance
and sustainable building programs and services may relate to
construction, in addition to renovation and retrofitting, of
buildings, and that such programs and services may be addressed to
clean energy sources and fuels (e.g., hydrogen) in addition to
renewable energy sources such as wind and solar. As we continue to
face significant challenges in the energy field, including the need
for more energy and the consequences of increased energy usage, we
cannot afford to limit our consideration of possible solutions to
accepted or established technologies.

AN  ACT  to  amend the public authorities law, in relation to the powers
  and duties of the power authority of the state of New York

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraphs 2 and 4 of paragraph (b) of subdivision 17 of
section  1005  of the public authorities law, as added by chapter 477 of
the laws of 2009 and such subdivision as renumbered  by  section  16  of
part  CC  of  chapter  60  of  the  laws of 2011, are amended to read as
follows:
  (2) "Energy-related projects,  programs  and  services"  means  energy
efficiency  projects  and  services[,]; clean energy technology projects
and services[, and]; RESEARCH,  DEVELOPMENT  AND  DEMONSTRATION  OF  NEW
SYSTEMS,  TECHNOLOGIES  AND MATERIALS RELATING TO ENERGY USAGE, STORAGE,
TRANSMISSION AND EFFICIENCY; high performance and  sustainable  building
programs  and  services[,  and];  the  construction, installation and/or
operation of facilities or equipment done in connection  with  any  such
projects, programs or services.
  (4)  "High performance and sustainable building programs and services"
means programs and services related to the CONSTRUCTION, renovation  and
retrofitting of buildings through the incorporation of standards, guide-
lines,  rating  systems, and/or criteria relating to design and building
techniques established by the authority pursuant to this section,  which
are  addressed to such issues as energy efficiency, energy conservation,
the use of CLEAN OR renewable energy OR FUELS, the reduction of air  and
other pollution, and the conservation of materials and resources such as
water.
  S 2. This act shall take effect immediately.
