2013-S2393 (ACTIVE) - Summary

Provides that a board of education may, at its discretion, provide transportation for pupils residing within the school district to a nonpublic school located more than fifteen miles from the home of such pupil; requires parents of pupils to reimburse for costs over fifteen miles; allows district to extend distance beyond fifteen miles upon approval of qualified voters in the district.

AN ACT to amend the education law,  in  relation  to  transportation  of
  certain pupils

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph b of subdivision 1 of section 3635 of the  educa-
tion  law  is  amended  by  adding  a  new subparagraph (iii) to read as
follows:
  (III) A BOARD OF EDUCATION MAY, AT ITS DISCRETION, PROVIDE TRANSPORTA-
TION FOR PUPILS RESIDING WITHIN THE DISTRICT WHO  ARE  NOT  ENTITLED  TO
TRANSPORTATION PURSUANT TO SUBPARAGRAPH (I) OR (II) OF THIS PARAGRAPH OR
ANY  OTHER  PROVISION OF THIS CHAPTER TO A NONPUBLIC SCHOOL LOCATED MORE
THAN FIFTEEN MILES FROM THE HOME OF ANY SUCH  PUPIL  PROVIDED  THAT  THE
PARENTS  OF  SUCH  PUPIL REIMBURSE THE DISTRICT FOR THE INCREMENTAL COST
ASSOCIATED WITH THE SEGMENT OF TRAVEL IN EXCESS OF FIFTEEN MILES OR SUCH
GREATER MILEAGE LIMIT APPROVED BY THE QUALIFIED VOTERS OF THE DISTRICT.
  S 2. This act shall take effect immediately.
