BILL NUMBER:S2585
TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to authorizing
the town of North Salem, in the county of Westchester, to regulate speed
limits on town highways
PURPOSE OR GENERAL IDEA OF BILL:
Provides for the Town of North Salem, County of Westchester, to control
the speed limits on town highways.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1: The first undesignated paragraph of section 1662-a of the
Vehicle and Traffic Law is designated subdivision 1 and a new
subdivision 2 is added to provide that the town board of North Salem may
establish speed limits on town highways in such town, other than state
or county highways maintained by the state or county department of
transportation. No such speed limit shall be established at less than
twenty-five miles per hour, except for school zone speed limits, which
may be established at not less than fifteen miles per hour.
JUSTIFICATION:
The purpose of this legislation is to provide the Town of North Salem
the authority to lower speed limits at their discretion on town roads.

AN ACT to amend the vehicle and traffic law, in relation to authorizing
the town of North Salem, in the county of Westchester, to regulate

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The opening paragraph of section 1662-a of the vehicle and
traffic law is designated subdivision 1 and a new subdivision 2 is added
to read as follows:
2. THE TOWN BOARD OF THE TOWN OF NORTH SALEM, IN THE COUNTY OF WEST-
CHESTER, MAY BY LOCAL LAW ESTABLISH MAXIMUM SPEED LIMITS AT WHICH VEHI-
CLES MAY PROCEED ON OR ALONG TOWN HIGHWAYS IN SUCH TOWN, OTHER THAN
STATE OR COUNTY HIGHWAYS MAINTAINED BY THE STATE OR COUNTY DEPARTMENT OF
TRANSPORTATION, LOWER THAN THE FIFTY-FIVE MILES PER HOUR STATUTORY MAXI-
MUM SPEED LIMIT. NO SUCH SPEED LIMIT APPLICABLE ON OR ALONG SUCH DESIG-
NATED HIGHWAYS WITHIN SUCH TOWN SHALL BE ESTABLISHED AT LESS THAN TWEN-
TY-FIVE MILES PER HOUR, EXCEPT THAT SCHOOL SPEED LIMITS MAY BE
ESTABLISHED AT NOT LESS THAN FIFTEEN MILES PER HOUR, FOR A DISTANCE NOT
TO EXCEED ONE THOUSAND THREE HUNDRED TWENTY FEET, ON A HIGHWAY PASSING A
SCHOOL BUILDING, ENTRANCE OR EXIT OF A SCHOOL ABUTTING ON THE HIGHWAY.
S 2. This act shall take effect on the thirtieth day after it shall
have become a law.

PURPOSE OR GENERAL IDEA OF BILL: Provides for the Town of North Salem,
County of Westchester, to control the speed limits on town highways.
SUMMARY OF SPECIFIC PROVISIONS: This bill amends section 1662-a of
the vehicle and traffic law to provide that the town board of North
Salem may establish speed limits on town highways in such town, other
than state or county highways maintained by the state or county
department of transportation. No such speed limit shall be established
at less than 25 per hour, except for school zone speed limits, which
may be established at not less than fifteen miles per hour.
JUSTIFICATION: The town of North Salem is surrounded by communities
that at the local level are able to control their own local speed
limits: the Town of Somers to the west; the Town of Lewisboro to the
south; and municipalities in the State of Connecticut to the east. The
Town of North Salem has in places, unpaved roads where 30 mph speed
limits (the state mandated speed limit) may not be safe, especially as
the same roads when they hit the Connecticut border only allow cars to
drive 25 mph.
