BILL NUMBER:S2717

TITLE OF BILL: An act to amend the public health law, in relation to
labeling of prescription drugs in languages other than English

PURPOSE: The purpose of this bill is to direct the commissioner of
health to promulgate rules and regulations for the labeling of
prescription drugs in another language other than English.

SUMMARY OF PROVISIONS: This bill intends to incorporate a new subdivi-
sion into Section 1.

Section 206 of the New York State Public Health Law. Subdivision 29
which will amend the New York State Public Health Law will state, that
the commissioner shall promulgate by rule and regulation criteria
directing pharmacies to provide prescription bottle labels, which
include instructions for taking the medicine, in languages other than
English.

JUSTIFICATION: Throughout the whole State of New York there a number of
different nationalities. Having such a diverse population we must make
some types of adjustments to accommodate everyone in our state. One of
the things that I want to change is the way that the prescription. drugs
label there products. There are only a few languages that are currently
translated to the label of prescription drugs. It's very dangerous that
some people don't understand the languages on these prescription drugs.
Not knowing what dosage to take and when to take a medicine is an issue
that a lot of people face today because they lack an understanding of
the language in which prescription drugs are written in. We should
provide a system were a customer comes in and they ask for a language of
choice and they get that language they ask for on their prescription
label. By having more available language translations of prescription
drugs we provide more safety for anyone who are taking prescription
drugs.

FISCAL IMPLICATIONS: None.

LOCAL FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: On the 120th day it shall have become law; provided,
however that effective immediately, the addition, amendment and/or

repeal of any rule or regulation necessary for the implementation of
this act on its effective date.

AN ACT to amend the public  health  law,  in  relation  to  labeling  of
  prescription drugs in languages other than English

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 206 of the public health law is amended by adding a
new subdivision 29 to read as follows:
  29. THE COMMISSIONER SHALL PROMULGATE BY RULE AND REGULATION  CRITERIA
DIRECTING  PHARMACIES  TO  PROVIDE  PRESCRIPTION  BOTTLE  LABELS,  WHICH
INCLUDE INSTRUCTIONS FOR TAKING THE MEDICINE, IN  LANGUAGES  OTHER  THAN
ENGLISH.
  S 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law. Provided, however, that effective immediate-
ly,  the  addition,  amendment  and/or  repeal of any rule or regulation
necessary for the implementation of this act on its effective  date  are
authorized  and  directed  to  be  made  and completed on or before such
effective date.
