TITLE OF BILL: An act to amend the education law, in relation to
expenses for transportation of students to and from extracurricular
activities
PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to
provide state aid for transportation of students to and from extracur-
ricular activities.
SUMMARY OF SPECIFIC PROVISIONS: Subdivision 6 and 7 of section 3622-a
of the education law, subdivisions 6 as amended and subdivision 7 as
added by chapter 422 of the laws of 2004, are amended and a new subdivi-
sion 8 is added.
JUSTIFICATION: This legislation would allow for state reimbursement to
school districts for the transportation of pupils to and from school
sponsored extracurricular activities, provided however that a school
district shall only receive fifty percent of the cost of such transpor-
tation.
Under current law, school districts must pay the total cost of extracur-
ricular transportation. This expense has a negative impact on all
schools but for large rural schools in particular, which must travel far
and frequently to compete in after school athletic trips and excursions.
Existing law has no provision granting state aid for the transportation

AN ACT to amend the education law, in relation to expenses for transpor-
tation of students to and from extracurricular activities
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivisions 6 and 7 of section 3622-a of the education
law, subdivision 6 as amended by section 47 of part A of chapter 58 of
the laws of 2011 and subdivision 7 as added by chapter 422 of the laws
of 2004, are amended and a new subdivision 8 is added to read as
follows:
6. Transportation of pupils to and from approved summer school
programs operated by a school district in the two thousand--two thousand
one school year and thereafter, provided, however, that if the total
statewide apportionment attributable to allowable transportation
expenses incurred pursuant to this subdivision exceeds five million
dollars ($5,000,000), individual school district allocations shall be
prorated to ensure that the apportionment for such summer transportation
does not exceed five million dollars ($5,000,000), provided that such
prorated apportionment computed and payable as of September one of the
school year immediately following the school year for which such aid is
claimed shall be deemed final and not subject to change; [and]
7. Transportation provided pursuant to section thirty-six hundred
thirty-five-b of this article[.]; AND
8. TRANSPORTATION OF PUPILS TO AND FROM SCHOOL SPONSORED EXTRACURRIC-
ULAR ACTIVITIES, PROVIDED HOWEVER THAT A SCHOOL DISTRICT SHALL ONLY
RECEIVE FIFTY PERCENT OF THE COST OF SUCH TRANSPORTATION.
S 2. This act shall take effect immediately and shall apply to school
years beginning on and after July 1, 2014.
