BILL NUMBER:S3414

TITLE OF BILL: An act to amend the general business law, in relation to
disclosure of social security numbers

PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to amend a
chapter of the laws of 2012 relating to the disclosure of social securi-
ty numbers.

SUMMARY OF SPECIFIC PROVISIONS: This bill would amend the general busi-
ness law by removing disclosure restrictions placed on numbers derived
from a social security number and would permit disclosure of social
security numbers collected in furtherance of compliance with a federal,
state, or local law or regulation.

JUSTIFICATION: In place of using social security numbers, some entities
use alternate identification numbers that are associated with an indi-
vidual's social security number. This bill would specifically permit the
use of this identification number.

Further, this bill would allow the use of a social security number if it
is used in order to comply with a federal, state, or local law or regu-
lation.

EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the general business law, in relation to  disclosure  of
  social security numbers

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 1 and paragraph (b) of subdivision 3 of section
399-ddd of the general business law, as added by chapter 372 of the laws
of 2012, are amended to read as follows:
  1.  As used in this section, "social security  account  number"  shall
include  the number issued by the federal social security administration
[and any number derived from such number].  Such term shall not  include
any number that has been encrypted.
  (b) The social security account number is expressly required by feder-
al,  state,  or local law or regulation OR IS COLLECTED TO ALLOW COMPLI-
ANCE WITH A FEDERAL, STATE, OR LOCAL LAW OR REGULATION.
  S 2. This act shall take effect immediately.
