BILL NUMBER:S3527 TITLE OF BILL: An act to direct the department of environmental conser- vation to grant Robert Zickmund, Sr. a license to fish conch PURPOSE: To grant Robert Zickmund, who held a conch license for the years of 2000-2002 and has been denied the right to be issued a license in 2013. SUMMARY OF PROVISIONS: Directs the Department of Environmental Conser- vation to issue Mr. Zickmund a conch license. EXISTING LAW: The law provided that only those who had conch licenses in 2003 would be entitled to continue as preferred licensees. JUSTIFICATION: Mr. Zickmund had a conch license for three years and has been a commercial fisherman since the 1970's. He failed to purchase a conch license in 2003 concentrating on other fish species. He had no idea that failure to purchase a license for one year would bar him from the license for the past nine years. This is an injustice to an individ- ual who has spent his life in the fishing industry, LEGISLATIVE HISTORY: 2012 S.7266/A.10055 FISCAL IMPLICATIONS: None.

LOSQUADRO -- read once and referred to the Committee on Environmental Conservation AN ACT to direct the department of environmental conservation to grant Robert Zickmund, Sr. a license to fish conch THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding paragraph c of subdivision 4 of section 13-0328 of the environmental conservation law or any other provision of law, Robert Zickmund, Sr., who held a commercial license to fish conch in the years 2000, 2001 and 2002, shall be deemed to have held a commer- cial license to fish conch in 2011 thereby making him eligible to be issued a commercial license to fish conch for calendar year 2013. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD06180-01-3
