Introduced  by  Sen.  LARKIN -- read twice and ordered printed, and when
  printed to be committed to the Committee on Cultural Affairs, Tourism,
  Parks and Recreation

AN ACT to amend the parks, recreation and historic preservation law,  in
  relation  to certain reimbursements for the provision of ambulance and
  fire response

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 9.05 of the parks, recreation and historic preser-
vation law is amended by  adding  a  new  subdivision  3-a  to  read  as
follows:
  3-A.  REIMBURSE ANY VOLUNTEER AMBULANCE COMPANY AS DEFINED IN SUBDIVI-
SION TWO OF SECTION THREE OF THE VOLUNTEER  AMBULANCE  WORKERS'  BENEFIT
LAW  OR  ANY  VOLUNTEER  FIRE  COMPANY  AS DEFINED IN SUBDIVISION TWO OF
SECTION THREE  OF  THE  VOLUNTEER  FIREFIGHTERS'  BENEFIT  LAW  FOR  THE
PROVISION  OF  ANY  FIRE  OR  OTHER  EMERGENCY SERVICES RENDERED BY SUCH
VOLUNTEER AMBULANCE COMPANY OR VOLUNTEER FIRE COMPANY IN  THE  PALISADES
INTERSTATE  PARK  BY  SUCH  AMBULANCE  COMPANY  OR FIRE COMPANY. FOR THE
PURPOSES OF THIS SUBDIVISION, THE VALUE OF  SERVICES  FOR  A  PARTICULAR
ACCIDENT  OR  INCIDENT  SHALL  BE ESTABLISHED BY THE VOLUNTEER AMBULANCE
COMPANY OR THE VOLUNTEER FIRE COMPANY,  BY  CONSIDERATION  OF  SALARIES,
BENEFITS  AND  TIME  OF  PERSONNEL  ASSIGNED  TOGETHER WITH THE PRO RATA
EXPENSES OF PRODUCTS, VEHICLES AND  EQUIPMENT  UTILIZED.  STATEMENTS  OF
QUALIFYING  CLAIMS SHALL BE SUBMITTED BY THE VOLUNTEER AMBULANCE COMPANY
OR VOLUNTEER FIRE COMPANY TO THE COMMISSION WITHIN NINETY  DAYS  OF  THE
OCCURRENCE OF THE ACCIDENT OR INCIDENT.
  S  2.  This act shall take effect immediately; provided, however, that
effective immediately, the addition, amendment and/or repeal of any rule
or regulation necessary for the implementation of this act on its effec-
tive date are authorized and directed to be made  and  completed  on  or
before such effective date.
