TITLE OF BILL:
An act
to amend the criminal procedure law, in relation to United States
Environmental Protection Agency special agents

PURPOSE OR GENERAL IDEA OF BILL: This bill would
expand the list of
persons designated as peace officers to include Special Agents, with
law enforcement authority of the United States Environmental
Protection Agency.

SUMMARY OF SPECIFIC PROVISIONS: Section 2.15 of the
criminal procedure
law is amended by adding a new subdivision 28 to include Special
Agents with law enforcement authority within the United States
Environmental Protection Agency.

JUSTIFICATION: This bill is being introduced at the
request of the
United States Environmental Protection Agency, in order for their
special agents who presently have law enforcement authority to be
classified as Peace Officers.

Giving these agents Peace Officer status would allow these special
agents to better carry out their duties and responsibilities.

These agents are assigned to conduct investigations of environmental
crimes under statutes administered by Environmental Protection
Agency; providing technical expertise on unique or complex criminal
and civil investigations impacting environmental programs for air,
water, toxics, pesticides, radiation, and solid waste pollution
control; providing legal support for enforcement actions; and
responding to incidents of national significance in support of
anti-terrorism and counter-terrorism efforts. These special agents
work with federal, tribal, state, local, and international law
enforcement in pursuing cases against violators.

AN ACT to amend the criminal procedure law, in relation to United States
  Environmental Protection Agency special agents

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  2.15 of the criminal procedure law is amended by
adding a new subdivision 28 to read as follows:
  28. UNITED STATES ENVIRONMENTAL PROTECTION AGENCY SPECIAL AGENTS  WITH
LAW ENFORCEMENT AUTHORITY.
  S 2. This act shall take effect immediately.
