BILL NUMBER:S4092 TITLE OF BILL: An act to authorize Hands Across Long Island, Inc. to retroactively apply for a real property tax exemption for certain prop- erty in the census-designated place of Ronkonkoma, town of Brookhaven, county of Suffolk PURPOSE: To authorize Hands Across Long Island, Inc. to file for a property tax exemption for property owned within the Town of Brookhaven. SUMMARY OF PROVISIONS: This bill would authorize the assessor of the Town of Brookhaven to accept from Hands Across Long Island an applica- tion or renewal application for exemption from real property taxes as if made pursuant to 420-a of the Real Property Tax Law. If satisfied that Hands Across Long Island, Inc. would otherwise have been entitled to such exemption, the assessor is authorized to grant the same, and cancel all remaining unpaid taxes, interest, related fines and penalties. JUSTIFICATION: Hands Across Long Island, Inc. has purchased a piece of real property located in the Town of Brookhaven for the purpose of providing mental health services to the community. It is intended by this bill to undo the hardships that will be suffered if the organiza- tion is required to pay property taxes that would otherwise not be due, if the organization had submitted their application for exemption in a timely manner.

ZELDIN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize Hands Across Long Island, Inc. to retroactively apply for a real property tax exemption for certain property in the census-designated place of Ronkonkoma, town of Brookhaven, county of Suffolk THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the town of Brookhaven is hereby authorized to accept from Hands Across Long Island, Inc., an application or renewal applica- tion for exemption from real property taxes pursuant to section 420-a of the real property tax law for the 2010-2011 assessment rolls, for the parcel owned by such non-profit organization which is located at 756 Hawkins Avenue, in the census-designated place of Ronkonkoma in the town of Brookhaven, county of Suffolk, otherwise known as Suffolk county tax map #0200.62000.0300.028000. If accepted, the application or renewal application shall be reviewed as if it had been received on or before the taxable status date established for such rolls. If satisfied that such organization would have otherwise been entitled to such exemption if such organization had filed an application for such exemption by the appropriate taxable status date, the assessor of the town of Brookhaven, upon approval by the town board of the town of Brookhaven, may grant exemption from all taxation with respect to the subject rolls and make appropriate corrections to the subject roll. If the exemption is granted and such organization shall have paid any tax with regard to the subject rolls, the town board may, in its sole discretion, provide for the refund of those taxes paid and cancel taxes, fines, penalties, liens or interest remaining unpaid.
