BILL NUMBER:S4481 TITLE OF BILL: An act to amend the election law, in relation to supplies to be provided at polling sites by the board of elections PURPOSE OR GENERAL IDEA OF BILL: To ensure that the Board of Elections provides enough pens at each polling site. SUMMARY OF SPECIFIC PROVISIONS: Section 1 requires that the Board of Elections provides enough pens at each Polling site to allow every voter to mark a ballot. Section 2 contains the effective date. JUSTIFICATION: New York's current voting system requires that voters use a pen to mark ballots. Voters do not expect to have to bring their own supplies to be able to vote. It is the responsibility of the Board of Elections to ensure that each polling site is prepared with supplies for Election Day, including an adequate supply of pens. PRIOR LEGISLATIVE HISTORY:

TKACZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to supplies to be provided at polling sites by the board of elections THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 8-108 to read as follows: S 8-108. SUPPLIES REQUIREMENT. EACH COUNTY BOARD OF ELECTIONS SHALL SUPPLY EACH POLLING SITE WITH AN ADEQUATE NUMBER OF PERMANENT INK WRIT- ING IMPLEMENTS SUITABLE FOR MARKING BALLOTS. S 2. This act shall take effect immediately.
