BILL NUMBER:S459

TITLE OF BILL:

An act
to amend the vehicle and traffic law and the administrative code of the
city of New York, in relation to certain traffic-control indications

PURPOSE OR GENERAL IDEA OF BILL:

The purpose of the bill is to increase the number of "red-light"
cameras in operation in the city of New York.

SUMMARY OF PROVISIONS:

Section 1 of the bill amends paragraph 1 of subdivision (a) of section
1111-a of the vehicle and traffic law, as amended by chapter 18 of
the laws of 2009, to increase the number of "traffic-control signal
photo violation monitoring devices" in operation from one hundred
fifty intersections to two hundred fifty intersections.

Section 2 of the bill amends paragraph 1 of subdivision (a) of section
19-210 of the administrative code of the city of New York, as amended
by chapter 18 of the laws of 2009, to increase the number of
"traffic-control signal photo violation-monitoring devices" in
operation from one hundred fifty intersections to two hundred fifty
intersections.

Section 3 sets an immediate effective date, except that it does not
affect the repeal of section 1111-a of the vehicle and traffic law
and shall not effect the expiration of section 19-210 of the
administrative code of the city of New York.

JUSTIFICATION:

The "Red Light Camera" program has proved effective in addressing the
ever increasing problem of drivers speeding through intersections to
"beat" a red light which poses great danger to other motorists and
pedestrians.

The New York City Police Department has neither the man power nor the
budget to provide enforcement coverage at the thousands of
intersections throughout the city of New York. The "Red Light Camera"
program is a vital tool in enforcement of the traffic laws in the
city and deserves to be expanded by another 100 intersections.

AN ACT to amend the vehicle and traffic law and the administrative  code
  of  the city of New York, in relation to certain traffic-control indi-
  cations

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph  1  of subdivision (a) of section 1111-a of the
vehicle and traffic law, as amended by chapter 18 of the laws  of  2009,
is amended to read as follows:
  1.  Notwithstanding any other provision of law, each city with a popu-
lation of one million or more is  hereby  authorized  and  empowered  to
adopt  and  amend  a local law or ordinance establishing a demonstration
program imposing monetary liability on the owner of a vehicle for  fail-
ure of an operator thereof to comply with traffic-control indications in
such city in accordance with the provisions of this section. Such demon-
stration  program  shall  empower a city to install and operate traffic-
control signal photo violation-monitoring devices at no more than  [one]
TWO hundred fifty intersections within such city at any one time.
  S  2. Paragraph 1 of subdivision (a) of section 19-210 of the adminis-
trative code of the city of New York, as amended by chapter  18  of  the
laws of 2009, is amended to read as follows:
  1.  Notwithstanding any other provision of law, the parking violations
bureau is hereby authorized and empowered to establish  a  demonstration
program  imposing monetary liability on the owner of a vehicle for fail-
ure of an operator thereof to comply with traffic-control indications in
accordance with the provisions of this section. The department of trans-
portation, for purposes of implementation  of  such  program,  shall  be
authorized  to  install  and operate traffic-control signal photo viola-

tion-monitoring devices at no more than [one] TWO hundred  fifty  inter-
sections at any one time.
  S  3.  This act shall take effect immediately, provided, however, that
the amendments to paragraph 1 of subdivision (a) of  section  1111-a  of
the  vehicle  and  traffic law made by section one of this act shall not
affect the repeal of such section and shall be  deemed  repealed  there-
with;  and  provided,  further,  that  the  amendments to paragraph 1 of
subdivision (a) of section 19-210 of the administrative code of the city
of New York made by section two of this act shall not affect the expira-
tion of such section and shall be deemed to expire therewith.

PURPOSE OF GENERAL IDEA OF BILL: The purpose of the bill is to make
the current "red light camera" pilot program permanent and to increase
the number of "red-light" cameras in operation in the city of New York
from one hundred and fifty to two hundred and fifty intersections.

SUMMARY OF PROVISIONS:

Section 1 of the bill amends paragraph 1 of subdivision (a) of section
1111-a of the vehicle and traffic law, as amended by chapter 18 of the
laws of 2009, to increase the number of "traffic-control signal photo
violation-monitoring devices" in operation from one hundred fifty
intersections to two hundred fifty intersections.

Section 2 of the bill amends paragraph 1 of subdivision (a) of section
19-210 of the administrative code of the city of New York, as amended
by chapter 18 of the laws of 2009, to increase the number of
"traffic-control signal photo violation-monitoring devices" in
operation from one hundred fifty intersections to two hundred fifty
intersections.

Section 3 of the bill amends Section 17 of chapter 746 of the laws of
1988 amending the vehicle and traffic law, the general municipal law
and the public officers law, relating to the civil liability of
vehicle owners for traffic control signal violations, as amended by
chapter 18 of the laws of 2009 is amended by removing the repeal
language which has a current sunset date of December 1, 2014 thereby
making these provisions of law permanent.

Section 4 of the bill amends Section 2 of local law number 46 of the
city of New York for the year 1989 amending the administrative code of
the city of New York relating to civil liability of vehicle owners for
traffic control signal violations by removing the expiration date for
the law of December 1, 2014 thereby making this provision of law
permanent.

Section 5 sets an immediate effective date.

JUSTIFICATION: The "Red Light Camera" program has proved effective in
addressing the ever increasing problem of drivers speeding through
intersections to "beat" a red light which poses great danger to other
motorists and pedestrians.


The New York City Police Department has neither the man power nor the
budget to provide enforcement coverage at the thousands of
intersections throughout the city of New York. The "Red Light Camera"
program is a vital tool in enforcement of the traffic laws in the city
and deserves to be expanded by another 100 intersections.

The original provisions of law which created this pilot program will
sunset on December 1, 2014. However, given the success of the "Red
Light Camera" program since it was originally authorized more than 25
years ago, it is time to make this long standing successful program
permanent rather than being subjected to successive amendments that
continually extend a sunset date.

by  this act shall be deemed repealed; provided, however, any such local
laws as may be enacted pursuant to this act shall remain in  full  force
and effect only until the expiration on December 1, 2014].
  S  4. Section 2 of local law number 46 of the city of New York for the
year 1989 amending the administrative code  of  the  city  of  New  York
relating to civil liability of vehicle owners for traffic control signal
violations,  as amended by chapter 18 of the laws of 2009, is amended to
read as follows:
  S 2. This local law shall take effect immediately [and shall expire on
December 1, 2014].
  S 5. This act shall take effect immediately.
