BILL NUMBER:S4754

TITLE OF BILL: An act to amend the civil service law, in relation to
reduction of positions based upon seniority with an employer

PURPOSE OR GENERAL IDEA OF BILL:

This legislation amends the civil service law as it relates to sworn
members of the Suffolk County Police Department who, because of
economic conditions, consolidation or abolition of function, or
curtailment of activities, have had their positions in the competitive
class abolished or reduced in rank or salary grade. Through this
legislation, reduction of sworn members of the Suffolk County Police
Department shall be predicated upon original appointment on a
permanent basis in the grade or title in the service of the Suffolk
County Police Department.

SUMMARY OF PROVISIONS:

Section One amends Section 80 of the Civil Service Law by requiring
that reductions in this particular workforce be handled in inverse
order based upon original appointment to the particular position.

Section Two is the effective date.

JUSTIFICATION:

With the threat of layoffs and reductions within the County of Suffolk
Police Force, the organization representing the sworn members of the
police force request that the reduction position be based upon time in
grade or title rather than total time on the job. The legislature has
previously enacted similar legislation for the City of Buffalo, the
City of New York, the Monroe County Sheriff's Department, and the
Nassau County Police Force.

  printed to be committed to the Committee on Civil Service and Pensions

AN ACT to amend the civil service law, in relation to reduction of posi-
  tions based upon seniority with an employer

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subdivision 1-d of section 80 of the civil service law, as
added by chapter 731 of the laws of 2004, is amended to read as follows:
  1-d.  Notwithstanding  the  provisions  of  subdivision  one  of  this
section,  the  sworn members of the police force of the county of Nassau
AND THE SWORN MEMBERS OF THE POLICE FORCE OF THE COUNTY OF SUFFOLK shall
be subject to  the  following  procedure.  Where,  because  of  economy,
consolidation  or  abolition  of functions, curtailment of activities or
otherwise, positions in the competitive class are abolished  or  reduced
in  rank  or  salary  grade, suspension or demotion, as the case may be,
among incumbents holding the same or similar positions shall be made  in
the  inverse  order  of original appointment on a permanent basis in the
grade or title in the service of the governmental jurisdiction in  which
such  abolition  or  reduction  of  positions  occurs,  subject  to  the
provisions of subdivision seven of section eighty-five of this  chapter.
Notwithstanding  the  provisions  of this subdivision, however, upon the
abolition or reduction  of  positions,  those  employees  who  have  not
completed  their  probationary service shall be suspended or demoted, as
the case may be, before any permanent incumbents, and among such  proba-
tionary  employees  the  order of suspension or demotion shall be deter-
mined as if such employees were permanent incumbents.
  S 2. This act shall take effect immediately.
