BILL NUMBER:S5274 TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to defining boundaries of the Niagara river greenway PURPOSE OR GENERAL IDEA OF BILL: This bill would assist the Niagara Greenway Commission in it duty to establish a linear park system along the Niagara River, by outlining the boundaries of the greenway and disallowing portions of the greenway plan that are at odds with this statute. SUMMARY OF SPECIFIC PROVISIONS: Section 1 defines the physical boundaries of the Niagara River Greenway. Section 2 invalidates any portion of the Niagara River Greenway plan that is inconsistent with the statute. Any portion not consistent with the statute would be null and void; it would be stricken from the plan. JUSTIFICATION: The Niagara River Greenway was established to ensure that a linear

GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to defining boundaries of the Niagara river greenway THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 39.03 of the parks, recreation and historic preservation law, as added by chapter 460 of the laws of 2004, is amended to read as follows: 1. "Niagara river greenway" or "greenway" shall mean a linear system of state and local parks and conservation areas linked by a network of multi use trails within the greenway area WHICH SHALL INCLUDE LANDS: NO MORE THAN ONE THOUSAND FEET FROM THE SHORELINE OF THE NIAGARA RIVER, ITS MAJOR TRIBUTARIES, AND LAKE ERIE; NO MORE THAN FIVE HUNDRED FEET FROM THE SHORELINES IN URBANIZED AREAS; LESS THAN FIVE HUNDRED FEET FROM THE SHORELINE WHEN A MAJOR ROADWAY, RAILWAY LINE OR OTHER RIGHT OF WAY RUNS PARALLEL TO THE SHORE; ALL MAJOR LANDS, FACILITIES AND ELECTRIC POWER GENERATING STATIONS OWNED BY NEW YORK STATE THAT ABUT THE SHORELINE; AND ANY ADDITIONAL CRITERIA AS established by an approved plan of the commission as provided for in this article. S 2. The closing paragraph of section 39.07 of the parks, recreation and historic preservation law, as added by chapter 460 of the laws of 2004, is amended to read as follows: Such draft plan shall be submitted to the commissioner [of parks, recreation and historic preservation] within two years of the effective date of this article. The commissioner may approve the plan, may return the plan to the commission with recommendations for approval, or may reject such plan. Prior to submission of the draft plan to the commis- sioner, the commission shall hold at least one public hearing on the draft plan in each county for which the plan is applicable.
