BILL NUMBER:S6330

TITLE OF BILL: An act to amend the civil service law, in relation to
the administration of certain director of facility positions

PURPOSE: To clarify the purview of municipal civil service
commissions with regard to promotions for the school district
positions of Director of Facilities I, II and III.

SUMMARY OF SPECIFIC PROVISIONS:

Section one of the bill amends subdivision 5 of section 17 of the
Civil Service Law to clarify that the statewide examinations for the
school district positions of director of facilities do not affect the
ability of municipal civil service commissions to hold promotional
examinations and create promotional lists from such examinations for
those positions. The qualifications for promotion to those positions
that are established by a municipal civil service commission must be
consistent with the statewide eligibility criteria for those positions
established by the Department of Civil Service.

Section two of the bill provides that this act shall take effect
immediately.

EXISTING LAW: Currently, the Department of Civil Service is required
to develop a statewide open competitive examination for the positions
of Director of Facilities I, II and III in school districts.

JUSTIFICATION:

Chapter 403 of the Laws of 2011 provided that the Department of Civil
Service would develop and administer a statewide examination for the
school district positions of Director of Facilities I, II and III so
that school districts would have more candidates to consider for the
available positions. Chapter 403 did not address promotions within the
Director of Facilities titles. This bill clarifies the role of
municipal civil service commissions in the promotion process. This
clarification will pave the way for the administration of the new
statewide examination and promotional examinations based upon the new
statewide criteria for the Director of Facilities positions.

AN ACT to amend the civil service law, in relation to the administration
  of certain director of facility positions

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  5 of section 17 of the civil service law, as
added by chapter 403 of the laws of 2011, is amended to read as follows:
  5. Administration of certain director of facility positions.  Notwith-
standing the provisions of this section, chapter or  any  provisions  to
the  contrary  contained  in  any  general,  special, or local laws, the
department shall develop a statewide exam for the positions of  director
of  facilities  I,  II,  & III in school districts throughout the state.
Such administration shall include the development of eligibility  crite-
ria  for examination of potential candidates for the positions of direc-
tor of facilities I, II, & III based on qualifications and experience in
accordance with section fifty of this chapter. SUCH  STATEWIDE  EXAMINA-
TIONS  SHALL  NOT  AFFECT THE ABILITY OF MUNICIPAL CIVIL SERVICE COMMIS-
SIONS TO DETERMINE PROMOTION QUALIFICATIONS, ANNOUNCE PROMOTION EXAMINA-
TIONS AND  ESTABLISH  PROMOTION  ELIGIBLE  LISTS  FOR  THESE  POSITIONS,
CONSISTENT  WITH  STATEWIDE  ELIGIBILITY  CRITERIA  AS DETERMINED BY THE
DEPARTMENT. ANY SUCH PROMOTION EXAMINATION SHALL USE THE STATEWIDE EXAM-
INATION DEVELOPED BY THE DEPARTMENT.
