                                BILL NUMBER:S6428

TITLE OF BILL:  An act to amend the general municipal law and the
education law, in relation to authorizing municipal corporations to
consolidate services

PURPOSE:

To encourage improved economies of scale and cost efficiencies in how
services are provided by the local governments, school districts and
BOCES units by allowing them to enter into agreements for shared
and/or consolidated services.

SUMMARY OF PROVISIONS:

The first section of this bill amends the General Municipal Law by
adding a new article 17-B, which authorizes the sharing of services
between municipal governments, school districts, and BOCES units.

The second section of this bill amends the Education Law by adding a
new section 1510-A authorizing the sharing of services between
municipal governments, school districts, and BOCES units.

The third section of this bill amends Section 1604 of the Education
Law by adding a new Subdivision 43, related to the powers and duties
of authorizing such action by a board of trustees.

The fourth section of this bill amends Section 1709 of the Education
Law by adding a new subdivision 43, related to the powers and duties
of authorizing such action by a board of education.

The fifth section of this bill provides for an immediate effective
date.

JUSTIFICATION:

Given recent and continued economic struggles, costs borne by local
governing bodies, school districts, and BOCES units in providing
services continue to rise. These entities could benefit from being
able to consolidate the functions of their respective departments to
seek better economies of scale.

This legislation would allow local governments, school districts, and
BOCES units to enter into an agreement with one another, allowing them
to consolidate functions for the purpose of enabling a collaborative
and cost-effective approach to the procurement of services and
purchasing. It is anticipated that by providing more flexibility for
sharing services there will be substantial cost-savings to local
governments and the school districts, reduced duplication and improved
delivery of services.

FISCAL IMPLICATIONS:


This legislation would save both state and local tax dollars by
reducing administrative and operational costs.

EFFECTIVE DATE:

This act would take effect immediately.

AN ACT to amend the general municipal law  and  the  education  law,  in
  relation to authorizing municipal corporations to consolidate services

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general municipal law is amended by adding a new  arti-
cle 17-B to read as follows:
                               ARTICLE 17-B
                        CONSOLIDATION OF SERVICES
SECTION 795. CONSOLIDATION OF SERVICES.
  S  795. CONSOLIDATION OF SERVICES. ANY MUNICIPAL CORPORATION MAY ENTER
INTO AN AGREEMENT WITH ANY OTHER MUNICIPAL CORPORATION, SCHOOL  DISTRICT
OR BOARD OF COOPERATIVE EDUCATIONAL SERVICES FOR THE SHARING OF SERVICES
AND FUNCTIONS.
  S  2.  The  education law is amended by adding a new section 1510-a to
read as follows:
  S 1510-A. SHARING OF SERVICES. ANY SCHOOL DISTRICT, BOARD  OF  COOPER-
ATIVE  EDUCATIONAL  SERVICES  OR  MUNICIPAL CORPORATION, AS THAT TERM IS
DEFINED BY SECTION TWO OF THE GENERAL MUNICIPAL LAW, MAY ENTER  INTO  AN
AGREEMENT  WITH  ANY  OTHER SCHOOL DISTRICT, BOARD OF COOPERATIVE EDUCA-
TIONAL SERVICES OR MUNICIPAL CORPORATION FOR THE SHARING OF SERVICES AND
FUNCTIONS.
  S 3. Section 1604 of the education law is  amended  by  adding  a  new
subdivision 43 to read as follows:
  43.  TO  AGREE  OR CONTRACT WITH ANY SCHOOL DISTRICT, BOARD OF COOPER-
ATIVE EDUCATIONAL SERVICES OR MUNICIPAL CORPORATION,  AS  THAT  TERM  IS
DEFINED  BY SECTION TWO OF THE GENERAL MUNICIPAL LAW, FOR THE SHARING OF
SERVICES AND FUNCTIONS.
  S 4. Section 1709 of the education law is  amended  by  adding  a  new
subdivision 43 to read as follows:
  43.  TO  AGREE  OR CONTRACT WITH ANY SCHOOL DISTRICT, BOARD OF COOPER-
ATIVE EDUCATIONAL SERVICES OR MUNICIPAL CORPORATION,  AS  THAT  TERM  IS
DEFINED  BY SECTION TWO OF THE GENERAL MUNICIPAL LAW, FOR THE SHARING OF
SERVICES AND FUNCTIONS.
  S 5. This act shall take effect immediately.
