BILL NUMBER:S7802

TITLE OF BILL: An act Authorizing the town of Brookhaven to re-convey
to Rock Solid Corporation parcels of land not needed for open space
purposes

PURPOSE: To enable the Town of Brookhaven to re-convey to Rock Solid
Corporation parcels of land not needed for open space purposes.

SUMMARY OF PROVISIONS:

Section one authorizes the Brookhaven Town Board to re-convey, to Rock
Solid Corporation, certain parcels of land, upon such terms as the
Town Board deems reasonable.

Section two describes the parcels of land. Section three is the
effective date.

JUSTIFICATION: In December 2012, Rock Solid Corporation conveyed
several parcels of land to the Town of Brookhaven in exchange for
sanitary credits needed for the development of a larger plot of land.
Pursuant to Resolution 2012-976 of the Town Board, this land was to
kept for open space purposes. However, through no fault of their own,
the intended purchaser of the larger plot defaulted on the contract of
purchase.

This bill is meant to authorize the re-conveyance of the plots of land
that were traded to the town for sanitary credits, thereby putting
Rock Solid in the same position that they were prior to the
purchaser's default.

LEGISLATIVE HISTORY: This is new legislation.

FISCAL IMPLICATIONS: None to the state.

LOCAL FISCAL IMPLICATIONS: None noted.

EFFECTIVE DATE: This act shall take effect immediately.

AN ACT Authorizing the town of Brookhaven to  re-convey  to  Rock  Solid
  Corporation parcels of land not needed for open space purposes

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any provision of law to the  contrary,  the
town  of  Brookhaven,  county of Suffolk, acting by and through its town
board, is hereby authorized to re-convey to Rock Solid Corporation  upon
such  terms  it  deems  reasonable,  but without monetary consideration,
those parcels of land described in section two of this act, which are no
longer needed for open space purposes.
  S 2. The parcels of land, with the buildings and improvements thereon,
erected situate, lying and being in the town of  Brookhaven,  county  of
Suffolk,  state of New York, known and designated as Lots 1, 2, 3, 4, 5,
6 and 8 on a certain map entitled "Map of Village  Woods  Situate  Bell-
port".  Said  map was filed in the office of the clerk for the county of
Suffolk on the twenty-first day of January, two thousand  nine,  as  map
number 11675.
  S 3. This act shall take effect immediately.
