AN ACT to amend the public authorities law, in relation to prohibiting
public authorities from charging separate and higher toll rates for
out-of-area E-ZPass drivers who reside in New York state
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The public authorities law is amended by adding a new
section 2976-b to read as follows:
S 2976-B. E-ZPASS TOLL RATES; OUT-OF-AREA DRIVERS. NOTWITHSTANDING
ANY PROVISION OF GENERAL, SPECIAL OR LOCAL LAW TO THE CONTRARY, NO
AUTHORITY OF THIS STATE SHALL BE ALLOWED TO CHARGE A SEPARATE OR HIGHER
TOLL RATE TO AN ACCOUNT HOLDER OF AN ELECTRONIC TOLL COLLECTION SYSTEM,
ALSO KNOWN AS E-ZPASS, WHO IS A RESIDENT OF NEW YORK STATE, BUT IS NOT A
RESIDENT OF A SPECIFIC AREA OR REGION, OR IS NOT A HOLDER OF SUCH
AUTHORITY'S OR TOLL AGENCY'S E-ZPASS ACCOUNT.
S 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law; provided, however, that effective immediate-
ly, the addition, amendment and/or repeal of any rule or regulation
necessary for the implementation of this act on its effective date is
authorized and directed to be made and completed on or before such
effective date.
