AN  ACT to amend the public health law, in relation to prohibiting smok-
  ing in indoor common areas of multiple dwelling properties

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraphs  q and r of subdivision 1 of section 1399-o of
the public health law, as amended by chapter 389 of the  laws  of  2011,
are amended and a new paragraph s is added to read as follows:
  q. zoos; [and]
  r. bingo facilities[.]; AND
  S.  COMMON AREAS OF MULTIPLE DWELLINGS, INCLUDING ELEVATORS, HALLWAYS,
ENTRANCES, AND EXITS. FOR THE PURPOSES OF THIS PARAGRAPH:
  (1) "MULTIPLE DWELLING" SHALL MEAN A DWELLING  THAT  IS  OCCUPIED  FOR
PERMANENT  RESIDENCE PURPOSES OF THREE OR MORE FAMILIES LIVING INDEPEND-
ENTLY OF EACH OTHER.
  (2) "PERMANENT RESIDENCE PURPOSES" SHALL CONSIST  OF  OCCUPANCY  OF  A
DWELLING  UNIT  BY  THE SAME NATURAL PERSON OR FAMILY FOR THIRTY CONSEC-
UTIVE DAYS OR MORE.
  (3) "DWELLING UNIT" SHALL MEAN ANY ROOM  OR  GROUP  OF  ROOMS  LOCATED
WITHIN  A  DWELLING  AND FORMING A SINGLE HABITABLE UNIT WITH FACILITIES
WHICH ARE USED OR INTENDED TO BE USED FOR LIVING OR  SLEEPING  BY  HUMAN
OCCUPANTS.
  S  2. This act shall take effect one year after it shall have become a
law.
