TITLE OF BILL:  An act to amend the public housing law and the
administrative code of the city of New York, in relation to non-rental
fees charged by landlords

PURPOSE OR GENERAL IDEA OF BILL: This bill would require the Division
of Housing and Community Renewal (DHCR) to publish an informational
pamphlet providing information on the most common non-rental fees that
DHCR authorizes landlords to impose on tenants and provides for the
distribution of the pamphlets to landlords and ultimately to tenants
of rent regulated housing.

SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends section 14 of the public housing law by adding a new
subdivision 7 that would require the Division of Housing and Community
Renewal to produce and distribute annually, a pamphlet outlining the
most common non-rental fees authorized by the Division to be imposed
by landlords upon tenants.

Section 2 amends the administrative code of the city of New York by
adding a new section 26-412.1 that would require every landlord of
housing accommodation subject to that section or the emergency tenant
protection act of 1974 to provide on an annual basis the pamphlet of
information relating to non-rental fees which is developed and

distributed annually by DHCR.

Section 3 sets the effective date.

JUSTIFICATION: Recently the New York Times brought to light the issue
many low-income New Yorkers are facing from their landlords of rent
regulated apartments. Non-rental fees have become a new tactic of
landlords to either coerce tenants into paying money for various types
of fees they do not actually owe, or to push tenants out of their
apartment altogether.

This legislation would help tenants to understand what the fees their
landlord may legally charge them, why they are being charged, and
other useful information that would help clarify this often confusing
set of fees that are often collected along side rent. Often times fees
can appear on a rent bill or other correspondence that a tenant might
not understand or there is no explanation. Tenants are coerced to
believe they need to pay the fees or their housing can be in jeopardy,
which is not always the case.

FISCAL IMPLICATIONS:  None to the State.

EFFECTIVE DATE: This act shall take effect immediately; provided that
section 26-412.1 of the city rent and rehabilitation law as added by
section two of this act shall remain in full force and effect only as
long as the public emergency requiring the regulation and control of
residential rents and evictions continues, as provided in subdivision

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 14 of the public housing law is amended by adding a
new subdivision 7 to read as follows:
  7.  THE  DIVISION  OF  HOUSING  AND COMMUNITY RENEWAL SHALL PUBLISH AN
INFORMATIONAL PAMPHLET SETTING FORTH THE  MOST  COMMON  NON-RENTAL  FEES
AUTHORIZED  TO  BE  IMPOSED BY LANDLORDS. THE LIST SHALL INCLUDE A SHORT
DESCRIPTION OF SUCH FEES. THE PUBLICATION SHALL BE MADE AVAILABLE ON THE
DIVISION'S WEBSITE AND SHALL BE DISTRIBUTED ANNUALLY TO OWNERS OF  HOUS-
ING  ACCOMMODATIONS WHICH ARE SUBJECT TO THE EMERGENCY TENANT PROTECTION
ACT OF NINETEEN SEVENTY-FOUR, THE EMERGENCY HOUSING RENT CONTROL LAW, OR
THE LOCAL EMERGENCY HOUSING RENT CONTROL ACT.  THE PUBLICATION SHALL  BE
AVAILABLE  IN  ENGLISH, ARABIC, CHINESE, HAITIAN CREOLE, KOREAN, RUSSIAN
AND SPANISH.
  S 2. The administrative code of the city of New  York  is  amended  by
adding a new section 26-412.1 to read as follows:
  S  26-412.1  NON-RENTAL FEES. EVERY LANDLORD OF HOUSING ACCOMMODATIONS
SUBJECT TO THIS CHAPTER OR THE EMERGENCY TENANT PROTECTION ACT OF  NINE-
TEEN  SEVENTY-FOUR  SHALL  ANNUALLY PROVIDE TO EACH TENANT A COPY OF THE
PAMPHLET INFORMATION RELATING TO NON-RENTAL FEES WHICH IS DEVELOPED  AND
DISTRIBUTED BY THE DIVISION OF HOUSING AND COMMUNITY RENEWAL PURSUANT TO
SUBDIVISION SEVEN OF SECTION FOURTEEN OF THE PUBLIC HOUSING LAW.
  S  3.  This  act  shall take effect immediately; provided that section
