BILL NUMBER:S6408 TITLE OF BILL: An act to authorize the Middletown-Hardenburgh fire district to extend the fire district into the village of Margaretville PURPOSE: Authorizes the Middletown-Hardenburgh Fire District to extend the fire district into the Village of Margaretville. SUMMARY OF PROVISIONS: Section 1 provides for the Village of Margaretville to terminate its fire protection contract with the Middletown-Hardenburgh Fire District and for the Middletown-Hardenburgh Fire District to include the Village of Margaretville. Section 2 authorizes the Middletown-Hardenburgh Fire District to consolidate with the Village of Margaretville thereby. Section 3 - The corporate existence of the Middletown-Hardenburgh Fire District shall continue and remain a fire district administered by five (5) fire commissioners. Section 4 - The Village of Margaretville and the Middletown-Hardenburgh Fire District shall use the existing procedures

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the Middletown-Hardenburgh fire district to extend the fire district into the village of Margaretville THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any contrary provisions of article 11 of the town law, commencing upon the effective date of a resolution adopted by the village of Margaretville, in the county of Delaware, pursuant to section 170 of the town law governing fire districts, to consolidate the village of Margaretville into the Middletown-Hardenburgh fire district, which surrounds the village of Margaretville, for the purposes of fire protection. S 2. Upon the completion by the village of Margaretville of the proceedings authorized by section one of this act, the fire district shall include the village of Margaretville, and the Middletown-Harden- burgh fire district shall continue to have all of the powers, duties, and responsibilities it possessed prior to the enactment of this act, and shall be subject to all of the limitations, procedures, and restrictions set forth in such section. S 3. On and after the completion of proceedings authorized by section one of this act, the fire district shall maintain its existence and continue to maintain apparatus, appliances and facilities as it did before the enactment of this act. Nothing in this act shall give the village of Margaretville control over the fire district beyond the provisions of the town law. S 4. The village of Margaretville and the Middletown-Hardenburgh fire district shall use the existing procedures of section 170 of the town law for adoption of the resolutions to consolidate the village of Margaretville into the Middletown-Hardenburgh fire district; provided, however, that nothing in this act shall alleviate the village of Margar- etville from complying with the provisions of section 170 of the town law. SUMMARY OF PROVISIONS: Section 1 abolishes the fire department in the Village of Margaretville, outlines the purpose of the legislation and provides for the Middle- town-Hardenburgh Fire District to include the Village of Margaretville. Section 2 states that the Middletown-Hardenburgh Fire District shall, upon proper procedure, extend into the Village of Margaretville and retain all of its powers under the law. Section 3 states the corporate existence of the not-for-profit Margaret- ville Volunteer Fire Department, Inc. shall continue to maintain appara- tus, appliances and facilities within the Village of Margaretville as it did before, but its continued presence shall not render it the fire corporation under the control of village authorities.

Notwithstanding any contrary provisions of article 11 of the town law, commencing upon the effective date of a resolution adopted pursuant to section 10-1020 of the village law abolishing the fire department in the village of Margaretville, Delaware County, the town boards of Middletown and Hardenburgh, in the county of Delaware, pursu- ant to subdivision 2 of section 170 of the town law governing fire districts, the boundary of the Middletown-Hardenburgh fire district shall be extended to include the territorial boundaries of the village of Margaretville for the purposes of fire protection. S 2. Upon the completion by the town boards of Middletown and Harden- burgh of the proceedings authorized by section one of this act, the fire protection district in the town as extended shall be governed by the provisions of section 184 of the town law, and the Middletown-Harden- burgh fire district shall continue to have all of the powers, duties, and responsibilities vested in and imposed on town boards by section 184 of the town law, and shall be subject to all of the limitations, proce- dures, and restrictions set forth in such section. S 3.
