AN ACT to amend the public health law, in relation to patient  self-det-
  ermination at end of life

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  article
28-F to read as follows:

                              ARTICLE 28-F
                     PATIENT SELF-DETERMINATION ACT
SECTION 2899-D. DEFINITIONS.
        2899-E. RIGHT TO INFORMATION.
        2899-F. IMMUNITY.
        2899-G. NO DUTY TO AID.
        2899-H. LIMITATIONS ON ACTIONS.
        2899-I. HEALTH CARE FACILITY EXCEPTIONS.
        2899-J. INSURANCE POLICIES; PROHIBITIONS.
        2899-K. NO EFFECT ON PALLIATIVE SEDATION.
        2899-L. PROTECTION OF PATIENT CHOICE AT END OF LIFE.
        2899-M. SAFE DISPOSAL OF UNUSED MEDICATIONS.
        2899-N. STATUTORY CONSTRUCTION.
  S 2899-D. DEFINITIONS. AS USED IN THIS ARTICLE:
  1.  "BONA  FIDE  PHYSICIAN-PATIENT  RELATIONSHIP"  MEANS A TREATING OR
CONSULTING RELATIONSHIP IN THE COURSE OF WHICH A PHYSICIAN HAS COMPLETED
A FULL ASSESSMENT OF THE PATIENT'S MEDICAL HISTORY AND  CURRENT  MEDICAL
CONDITION, INCLUDING A PERSONAL PHYSICAL EXAMINATION.
  2. "CAPABLE" MEANS THAT A PATIENT HAS THE ABILITY TO MAKE AND COMMUNI-
CATE  HEALTH  CARE  DECISIONS  TO  A  PHYSICIAN, INCLUDING COMMUNICATION
