AN ACT authorizing the city of Troy to alienate and convey certain
parcels of land used as parkland and to acquire other parcels of land
to replace such parkland
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The city of Troy, county of Rensselaer, acting by and
through its city council, is hereby authorized to discontinue and alien-
ate as parklands, the lands described in section three of this act.
S 2. The authorization provided in section one of this act shall be
effective only upon the condition that the city of Troy dedicate an
amount equal to or greater than the fair market value of the parklands
being alienated to the acquisition of new parklands and/or toward capi-
tal improvements to existing parkland and recreational facilities.
S 3. The lands to be discontinued as parklands and alienated and
conveyed is more fully described as follows:
ALL that certain tract, piece, or parcel of land, situate, lying and
being in the City of Troy, County of Rensselaer and the State of New
York, being more particularly bounded and described: BEGINNING at the
northeast corner of Federal Street and Sixth Avenue and running thence
along the easterly margin of Sixth Avenue N23° 16' 00" E for a distance
of 417.27 feet to a capped iron rod; Thence the following four (4)
courses along the lands conveyed to the Kennedy Towers Housing Develop-
ment Fund Company by a deed dated July 1, 2003 and recorded in the Rens-
selaer County Clerk's Office in Book of Deeds 548 at Page 318; S66° 44'
00" E for a distance of 7.77 feet to a capped iron rod at a point of

curvature; Thence southerly and easterly along a curve to the left
having delta angle of 68° 15' 00", a radius of 162.00 feet, an arc
length of 192.97 feet and having a chord bearing S 46° 23' 35" E for a
distance of 181.76 feet to a concrete monument found; Thence S 11° 21'
00" W for a distance of 162.99 feet to a concrete monument found; Thence
S 78° 33' 00" for a distance of 151.58 feet to a capped iron rod on the
westerly margin of relocate Peoples Street; THENCE along the westerly
and northerly margin of the relocated Peoples Street the following six
(6) courses: S 55° 28' 30" W for a distance of 68.74 feet to a point; N
83° 31' 30" W for a distance of 21.00 feet to a point; S 44° 58' 30" W
for a distance of 74.80 feet to a point; S 69° 28' 30" W for a distance
of 63.50 feet to a point; S 85° 28' 30" W for a distance of 50.00 feet
to a point; N 85° 31' 30" W for a distance of 9.52 feet to a capped iron
rod on the northerly margin of Federal Street; Thence westerly along the
northerly margin of Federal Street the following two (2) courses: N 71°
44' 00" W for a distance of 13.59 feet to a point; N 73° 52' 00" W for a
distance of 164.41 feet to the point and place of beginning, said parcel
of land containing about 1.95± acres of lands more or less.
S 4. If the land that is the subject of this act has received funding
pursuant to the federal land and water conservation fund, the discontin-
uance of parklands authorized by the provisions of this act shall not
occur until the municipality has complied with the federal requirements
pertaining to the conversion of parklands, including satisfying the
secretary of the interior that the discontinuance will include all
conditions which the secretary of the interior deems necessary to assure
the substitution of other lands shall be equivalent in fair market value
and recreational usefulness to the lands being discontinued.
S 5. This act shall take effect immediately.
