AN  ACT  to amend the vehicle and traffic law, in relation to refunds of
  the vehicle registration fees

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 1-a of section 428 of the vehicle and traffic
law, as added by section 76-a of part A of chapter 56  of  the  laws  of
1998, is amended to read as follows:
  1-a.  Notwithstanding  the  provisions  of  subdivision  one  of  this
section, if a registration is issued for a period of not less  than  two
years  pursuant  to  paragraph  c  of  subdivision  five of section four
hundred one of this [chapter] TITLE, the registration fee paid  for  the
period commencing after the [first twelve month period of such registra-
tion  shall  be  refunded less the sum of one dollar provided the number
plates are surrendered to the commissioner before the end of  the  first
twelve  month  period  of  such registration and application therefor is
filed with the commissioner within two months from the expiration of the
first twelve month  period  of  such  registration]  NUMBER  PLATES  ARE
SURRENDERED  TO  THE  COMMISSIONER  OR, IN THE CASE OF A STOLEN VEHICLE,
UPON SUBMISSION OF DOCUMENTATION SATISFACTORY TO THE COMMISSIONER, THERE
SHALL BE REFUNDED TO THE OWNER A SUM EQUAL TO AS MANY TWENTY-FOURTHS  OF
THE  FEE  PAID  FOR  THE  REGISTRATION  OF THE VEHICLE AS THERE ARE FULL
CALENDAR MONTHS IN THE REGISTRATION PERIOD FOLLOWING  THE  DATE  OF  THE
RECEIPT  OF  THE  NUMBER PLATES OR PLATE OR THE FILING OF AN APPLICATION
FOR A REFUND IF NO PLATES ARE AVAILABLE, LESS THE SUM OF ONE DOLLAR.
  S 2. Subdivision 3 of section 428 of the vehicle and traffic  law,  as
amended  by  chapter  262  of  the  laws  of 1969, is amended to read as
follows:
  3. Where a refund of any part of a registration fee is  made  pursuant
to  [the  foregoing  provisions] SUBDIVISION ONE, ONE-A, ONE-B OR TWO of
this  section,  the  registration  shall  thereupon   be   automatically
cancelled.
  S  3.  This  act shall take effect on the ninetieth day after it shall
have become a law.
