BILL NUMBER:S4412 TITLE OF BILL: An act to amend the village law, in relation to volunteer fire companies in certain counties PURPOSE OR GENERAL IDEA OF BILL: To allow fire companies to extend or renew an existing contract to provide services to a town in which the village is located SUMMARY OF SPECIFIC PROVISIONS: Section one amends section 10-1004 of the village law by adding a new section 2 to read as follows: A village fire, hose, protective or hook and ladder company may, without the consent of the village board of trustees or the village board of fire commissioners, enter into a contact to provide services to a town in which the village is located provided that (a) the services to be provided shall be limited to fire protection, general ambulance service, or emergency services in the case of accidents, calamities, or other emergencies, or any combination thereof (b) such contract shall be an extension or renewal of an existing contract for such services in the town. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law, in relation to volunteer fire companies in certain counties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 10-1004 of the village law is amended to read as follows: S 10-1004 Organization of companies. 1. The board of fire commission- ers, with the approval of the board of trustees, may organize and main- tain fire, hose, protective and hook and ladder companies, whenever in its judgment the public interests require. The board of fire commission- ers may, by resolution, with the approval of the board of trustees, consent to the incorporation of any of the companies so organized by them, or may, by like approval, consent to the incorporation or the organization without incorporation of as many companies voluntarily organized in said village as may be deemed necessary. 2. (A) A VILLAGE FIRE, HOSE, PROTECTIVE OR HOOK AND LADDER COMPANY LOCATED IN ANY COUNTY HAVING A POPULATION OF MORE THAN TWO HUNDRED SIXTEEN THOUSAND BUT LESS THAN TWO HUNDRED NINETEEN THOUSAND MAY, WITH- OUT THE CONSENT OF THE VILLAGE BOARD OF TRUSTEES OR THE VILLAGE BOARD OF FIRE COMMISSIONERS, ENTER INTO A CONTRACT TO PROVIDE SERVICES TO A TOWN IN WHICH THE VILLAGE IS LOCATED PROVIDED THAT: (I) THE SERVICES TO BE PROVIDED SHALL BE LIMITED TO FIRE PROTECTION, GENERAL AMBULANCE SERVICE, OR EMERGENCY SERVICES IN THE CASE OF ACCI- DENTS, CALAMITIES OR OTHER EMERGENCIES, OR ANY COMBINATION THEREOF; AND (II) SUCH CONTRACT SHALL BE AN EXTENSION OR RENEWAL OF AN EXISTING CONTRACT FOR SUCH SERVICES IN THE TOWN. (B) THE VILLAGE BOARD OF TRUSTEES MAY NOT ABOLISH A FIRE, HOSE, PROTECTIVE OR HOOK AND LADDER COMPANY PURSUANT TO SECTION 10-1020 OF THIS ARTICLE BASED IN WHOLE OR IN PART ON THE DECISION BY SUCH COMPANY TO ENTER INTO SUCH A CONTRACT EXTENSION OR RENEWAL.
