BILL NUMBER: S6599 TITLE OF BILL : An act to amend the public health law, in relation to sharing information for criminal investigations PURPOSE : This bill makes clear that the Department of Health (DOH) has authorization to disclose information relating to prescriptions for controlled substances to law enforcement agencies for the purpose of criminal investigations. SUMMARY OF PROVISIONS : Section one adds a new subdivision 30 to section 206 of the public health law to state that DOH shall make available any data or information regarding prescriptions for controlled substances to law enforcement agencies for criminal investigations. The law enforcement agencies receiving the information would be required to ensure that its use does not violate the health insurance portability and accountability act (HIPAA). HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to sharing informa- tion for criminal investigations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 206 of the public health law is amended by adding a new subdivision 30 to read as follows: 30. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, FOR THE PURPOSE OF CRIMINAL INVESTIGATIONS, THE COMMISSIONER SHALL MAKE AVAILABLE TO ANY FEDERAL, STATE, OR LOCAL LAW ENFORCEMENT AGENCY, ANY DATA OR INFORMATION IT HAS ACQUIRED RELATING TO PRESCRIPTIONS FOR CONTROLLED SUBSTANCES ISSUED IN THIS STATE. LAW ENFORCEMENT AGENCIES SHALL ENSURE THAT THE USE OF SUCH DATA OR INFORMATION OBTAINED FROM THE COMMISSIONER DOES NOT VIOLATE THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT. S 2.
