BILL NUMBER: S6776 TITLE OF BILL : An act to amend the real property law, in relation to massage therapist locations that promote prostitution and/or practice massage therapy without a license PURPOSE : This bill seeks to impose a duty on the landlords to terminate a tenancy of a massage therapist location found guilty of promoting prostitution within 60 days of notification to the landlord by a city or state agency. SUMMARY OF PROVISIONS : Section 1 of the bill to amends the real property law and adds section 228-a that requires a landlord to terminate a tenancy of a massage therapist location found to promote prostitution within 60 days of notification to the landlord by a city or state agency. Section 2 provides the sections of promoting prostitution in the Penal Law Section 3 provides the effective date. ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the real property law, in relation to massage therapist locations that promote prostitution and/or practice massage therapy without a license THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The real property law is amended by adding a new section 228-a to read as follows: S 228-A. TENANT LOCATION USED AS AN UNLICENSED MASSAGE THERAPY LOCATION AND/OR MASSAGE THERAPY THAT PROMOTES PROSTITUTION. A LANDLORD SHALL TERMINATE A TENANCY AND EVICT A TENANT WHO OPERATES A MASSAGE THERAPIST LOCATION ON THE LANDLORD'S PROPERTY WITHIN SIXTY DAYS OF NOTIFICATION TO THE LANDLORD BY A CITY OR STATE AGENCY THAT SUCH TENANT'S MASSAGE THERAPIST LOCATION: 1. PRACTICES MASSAGE THERAPY WITHOUT A PROFESSIONAL MASSAGE THERAPIST LICENSE IN VIOLATION OF SECTION SIX THOUSAND FIVE HUNDRED TWELVE OF THE EDUCATION LAW; AND/OR 2. PROMOTES PROSTITUTION AS DEFINED IN SECTION 230.15, 230.19, 230.20, 230.25, 230.30 OR 230.32 OF THE PENAL LAW. S 2. This act shall take effect immediately.
