BILL NUMBER: S7409 TITLE OF BILL : An act to amend the railroad law, in relation to requiring joint inspection of traffic signals PURPOSE : This legislation adds a new section to the railroad law which would establish a requirement that joint inspections of traffic signal locations that are interconnected with highway-railroad grade crossing warning systems be completed every two years and would direct the Department of Transportation (DOT) to oversee the program. SUMMARY OF PROVISIONS : Section one would add a new section 53-f to the railroad law to require every railroad corporation and every municipality having jurisdiction of a highway on which there is an "at grade" crossing to coordinate with DOT on a biennial inspection of any traffic control devices interconnected with a highway-rail at grade crossing warning system. Section two would set forth the effective date.

MURPHY -- (at request of the Department of Transpor- tation) -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the railroad law, in relation to requiring joint inspection of traffic signals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The railroad law is amended by adding a new section 53-f to read as follows: S 53-F. JOINT INSPECTION OF TRAFFIC SIGNALS. 1. NOTWITHSTANDING THE PROVISIONS OF ANY OTHER LAW TO THE CONTRARY, THE COMMISSIONER IS AUTHOR- IZED TO ESTABLISH, IMPLEMENT, AND EXERCISE OVERSIGHT OVER A PROGRAM OF INSPECTION OF TRAFFIC CONTROL DEVICES INTERCONNECTED WITH HIGHWAY-RAIL AT GRADE CROSSING WARNING SYSTEMS. 2. PURSUANT TO THE PROGRAM ESTABLISHED UNDER SUBDIVISION ONE OF THIS SECTION, THE DEPARTMENT OF TRANSPORTATION SHALL ESTABLISH A PROCEDURE APPLICABLE TO EVERY RAILROAD CORPORATION AND EACH MUNICIPALITY HAVING JURISDICTION OF A HIGHWAY ON WHICH THERE IS AN AT GRADE RAIL CROSSING. SUCH PROCEDURE SHALL PROVIDE FOR THE COORDINATED OPERATION AND BIENNIAL INSPECTION OF ANY TRAFFIC CONTROL DEVICES INTERCONNECTED WITH A HIGH- WAY-RAIL AT GRADE CROSSING WARNING SYSTEM. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided that, effective immediately, the commissioner of transportation is authorized to promulgate any rules or regulations necessary for the implementation of this act on its effec- tive date.
