AN ACT to amend the social services law, in relation to exempting teach-
  ers from additional certifications or  prerequisites  associated  with
  running certain after-school programs

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 17 of the social services law is amended by  adding
a new subdivision (h-1) to read as follows:
  (H-1)  GRANT ANY TEACHER CERTIFIED IN ACCORDANCE WITH 8 NYCRR PART 80,
AN EXEMPTION FROM ANY ADDITIONAL CERTIFICATION OR  PREREQUISITE,  EXCEPT
FOR  BACKGROUND  CHECKS  REQUIRED  UNDER PUBLIC LAW 113-186, REQUIRED TO
OPERATE ANY AFTER-SCHOOL PROGRAM OPERATED BY THE OFFICE OF CHILDREN  AND
FAMILY SERVICES, OR AN AFTER-SCHOOL PROGRAM FOR CHILDREN RUN BY A PUBLIC
SCHOOL  DISTRICT  OR  BY  A PRIVATE SCHOOL OR ACADEMY WHICH IS PROVIDING
ELEMENTARY OR SECONDARY  EDUCATION  OR  BOTH,  IN  ACCORDANCE  WITH  THE
COMPULSORY  EDUCATION  REQUIREMENTS  OF THE EDUCATION LAW, PROVIDED THAT
THE KINDERGARTEN,  PRE-KINDERGARTEN,  NURSERY  SCHOOL,  OR  AFTER-SCHOOL
PROGRAM  IS  LOCATED  ON  THE PREMISES OR CAMPUS WHERE THE ELEMENTARY OR
SECONDARY EDUCATION IS PROVIDED; EXCEPT FOR ANY TEACHER WORKING  IN  ANY
SCHOOL  BUILDING  OF A CITY SCHOOL DISTRICT OF A CITY HAVING ONE HUNDRED
TWENTY-FIVE THOUSAND INHABITANTS OR MORE.
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have  become  a  law; provided, however, that effective immediately, the
addition, amendment and/or repeal of any rule  or  regulation  necessary
for  the implementation of this act on its effective date are authorized
to be made and completed on or before such effective date.
